The Village Board may amend the provisions of this chapter pursuant
to Village Law § 7-708 and Municipal Home Rule Law Article
3 after public notice, public hearing, compliance with the State Environmental
Quality Review Act regulations (6 NYCRR Part 617), and following appropriate
referral to the county Planning Board pursuant to General Municipal
Law § 239-m.
Interpretation and application of the provisions of this chapter
shall be held to be minimal requirements, adopted for the promotion
of the public health, safety, or the general welfare. Whenever the
requirements of this chapter differ from the requirements of any other
lawfully adopted rules, regulations, or ordinances, the most restrictive,
or that imposing the higher standards, shall govern.
Should any article, section, subsection, sentence or clause
of this chapter be decided by the courts to be unconstitutional or
invalid, such decision shall not affect the validity of the law as
a whole or any part thereof other than the part so decided to be unconstitutional
or invalid.
The provisions of this chapter shall take effect upon filing
with the Secretary of State.
