It shall be unlawful for any person to engage in the unauthorized
use of a dumpster. The depositing of any materials of any type into
a dumpster other than that owned by the individual without permission
shall be a violation of this chapter.
Any person violating the terms of this chapter shall be guilty
of having committed an offense and shall be subject to a fine of not
less than $25 nor more than $100 for a first offense, and for a second
offense committed within a one-year period in a minimum amount of
$50 but not to exceed $150, and for a third or subsequent offense
committed within a one-year period by a fine of not less than $100
nor more than $250 and/or a term of imprisonment not to exceed 15
days or by both such fine and imprisonment. Each occasion there is
an unauthorized deposit in a dumpster shall be considered a separate
offense.
