The free public library established and heretofore created by the Borough of Vineland and the Township of Landis and now existing be and the same is hereby established as the Free Public Library of the City of Vineland and known as the "Vineland Free Public Library."

The Board of Trustees shall be increased from seven members to nine members, who shall hold in trust and manage all property of the library. Said Board shall be composed of the Mayor of the City of Vineland, the Superintendent of Schools of the Vineland School District and seven citizens to be appointed by the Mayor. The appointments shall be for terms of one, two, three, four and five years, respectively, as they may be selected by the Mayor. The terms of the two additional members increasing the number of Board members from seven to nine shall be for a term of five years. Upon the expiration of the term of office of any Trustee, the Mayor shall appoint a citizen for the term of five years in the same manner as the original appointment was made. Vacancies occurring in the Board of Trustees shall be filled for the unexpired term only, in the same manner as the original appointments are made. The Mayor and Superintendent of Schools serving as a member of the Board may, respectively, appoint an alternate to act in his/her place and stead with authority to attend all meetings of the Board and, in his/her absence, to vote on all questions before the Board.
The Trustees shall receive no compensation for their services and shall not incur any expense or enter into any obligation to an amount in excess of the annual appropriation for Library purposes and of the funds on hand.
The Board of Trustees shall annually make a report of its transactions and accounts and the state and condition of the Library to the governing body of the City.
The Board of Trustees shall have all the powers conferred by statute.
The governing body of the City of Vineland shall annually appropriate and raise by taxation the money needed for support and maintenance of the Library, as provided for by law.

No person shall detain or fail to return any book, periodical, pamphlet, artistic reproduction, phonograph recording, audiovisual material or any other article borrowed from the Vineland Public Library contrary to the rules and regulations of the Library after 30 days has elapsed from the date of posting by certified mail, return receipt requested, of a notice demanding return thereof, addressed to said person at the last address furnished to the Library. In the case of a minor, the notice shall be sent to the parents of the minor involved.
No person shall willfully or maliciously cut, tear, deface, disfigure, damage or destroy any book or other article or any part thereof which is owned by or is in the custody of the Library.
No person with intent to defraud shall register or furnish a false name or address or use any card other than the one issued to said person for the purpose of borrowing any book, periodical, pamphlet, artistic reproduction, phonograph recording, audiovisual material or any other article from the Library, nor shall any person allow the use of his or her library card by another individual. The obtaining of any book, periodical, pamphlet, artistic reproduction, phonograph recording, audiovisual material or any other article by means of the registration or furnishing of a false name or address or the use of a card other than the one issued to said person shall be prima facie evidence of intent to defraud.
The Library Board shall adopt and post, in a conspicuous place in the Vineland Public Library building, rules, regulations and procedures governing the borrowing of books, periodicals, pamphlets or any other item or article which may be available for such borrowing to the public.
No person shall remove any book, periodical, pamphlet, artistic reproduction, phonograph recording, audiovisual material or any other article or item from the Vineland Public Library building without complying with the rules, regulations and procedures of the Library for borrowing such items or articles.

Any person violating any provisions of this article or any rule or regulation promulgated thereunder, upon conviction thereof, shall be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty, exclusive of restitution to the Library for the costs of the damage or the loss of the article.
