[Amended at time of adoption of Code Revisions (see Ch. 1,
General Provisions, Art. III)]
A. No person, without a permit granted by the Code Enforcement
Officer, shall kindle or maintain any outdoor fire in the Village
of Hamilton except:
(1) In a covered, noncombustible container; or
(2) In a fireplace constructed of noncombustible material;
or
(3) In a noncombustible grill designed for cooking foods.
B. No outdoor fire, as in Subsection
A(1) above, shall be ignited within 15 feet of any structure or accumulation of combustible material.
C. The Code Enforcement Officer may issue outdoor fire
permits for the following reasons:
(1) For pep rallies or institutional events sponsored
and supervised by an educational institution certified by the State
of New York where such event takes place wholly on their property.
(2) Where such open fire is, in the opinion of the Code
Enforcement Officer, required to eliminate a public hazard and no
reasonable alternative is available for elimination of such hazard.
D. No outdoor fire requiring a permit shall be ignited
within 25 feet of any structure or accumulation of combustible material.
Any person who violates any provision of this chapter shall, upon conviction thereof, be punishable by the penalties set forth in Chapter
1, General Provisions, Article
II.
