Pursuant to N.J.S.A. 39:4-197 and N.J.S.A. 40:48-2.46,
the City of Vineland is authorized to establish handicapped parking
spaces in front of residences, schools, hospitals and other public
buildings and in shopping and business districts for use by persons
who have been issued special vehicle identification cards by the Division
of Motor Vehicles when using a motor vehicle on which is displayed
a handicapped person's certificate issued by the Division of Motor
Vehicles.
No person shall park a motor vehicle in any
parking space designated for handicapped persons unless the driver
or occupant of the vehicle is actually handicapped and said vehicle
bears a certificate, registration or license plate for handicapped
persons issued by the Division of Motor Vehicles.
Handicapped parking spaces shall meet specifications
as required by the Department of Transportation. Appropriate regulatory
and warning signs shall be erected and maintained as authorized by
the Department of Transportation. Such signs shall also state the
penalties set forth in this chapter.
Any person parking a motor vehicle in a handicapped
parking space without a special vehicle identification card shall
be liable to a fine of $250 for the first offense and, for subsequent
offenses, a fine of at least $250 and up to 90 days' community service
on such terms and in such form as the court shall deem appropriate,
or any combination thereof.
