This chapter shall be known as the "Freedom Plumbing Code."
The administration and enforcement of this chapter shall be the duty of the Code Enforcement Officer, who is hereby authorized to take such action as may be reasonably necessary to enforce the purposes of the code hereby adopted. The Code Enforcement Officer shall be appointed by the Borough Council of the Borough of Freedom. The Borough Council may appoint and authorize such assistants or agents of the Code Enforcement Officer as may be necessary to carry out the provisions of this code.
The provisions of this code shall apply to and govern plumbing as defined in this code, including the practice, materials and fixtures used in the construction, installation, maintenance, extension and alteration of all piping, fixtures, appliances and appurtenances in connection with any of the following: sanitary drainage or storm drainage facilities, venting systems and public or private water supply systems within or adjacent to any building or other structure; also the practice and materials used in the construction, installation, maintenance, extension or alteration of stormwater and sewage systems of any premises to their connections with any point of public disposal or other terminal.
It is recognized that only a portion of certain facilities in or adjacent to public streets, referred to in this code, are under the ownership or the control of the owner or occupant of the building or premises to which this code applies.
A. 
Standards adopted.
(1) 
There is hereby adopted by the Borough of Freedom for the purposes of prescribing regulations governing building that certain code known as the BOCA National Plumbing Code, 1993 Edition, except such portions thereof as are hereinafter deleted, modified or amended hereby, and all installations, repairs and alterations of plumbing shall, from the effective date of this chapter, be performed in accordance with its provisions.
(2) 
In the case of discretionary actions and determinations of the Code Enforcement Officer, the relevant facts shall be considered and determinations made in the exercise of reasonable discretion and all such determinations shall be final in absence of abuse of discretion.
B. 
Official copy. Three (3) copies of the BOCA National Plumbing Code, 1993 Edition, shall be kept on file by the Borough Secretary for inspection by the public and shall be marked with the words "Freedom Plumbing Code - Official Copy."
A. 
No work shall be done on construction of a sewer, drain, soil, waste or vent pipe on any building or structure before a permit shall have been issued by the Code Enforcement Officer.
B. 
The charge for plumbing permits shall be:
(1) 
New construction or additions: ten dollars ($10.), plus twenty-five dollars ($25.) for each additional fixture over six (6).
(2) 
Alterations (replacements of bathrooms and kitchens): five dollars ($5.), plus twenty-five cents ($0.25) for each additional fixture over six (6).
(3) 
Provided, however, that where the building plan shows an estimated cost in excess of one hundred thousand dollars ($100,000.), and the erection of said building shall be subject to federal, state or architectural inspection and approval, the plumbing permit fee shall be one hundred dollars ($100.).
A. 
Inspection and tests. It shall be the duty of the Code Enforcement Officer to enforce the provisions of this code and to make the inspections and tests required thereunder.
B. 
Right of entry. The Code Enforcement Officer shall, after proper identification, have the right to enter any premises for the purpose of inspecting any plumbing system at such times as may be reasonably necessary to protect the public health.
Whenever the Code Enforcement Officer shall deny an application or refuse to grant a permit or when it is claimed that the provisions of this code do not apply or that the true intent and meaning of this code have been misconstrued or misinterpreted, the applicant may appeal from the decision of the Code Enforcement Officer to the Freedom Code Review and Appeal Board within thirty (30) days from the date of this decision. The appointment of the membership of said Freedom Code Review and Appeal Board, its powers and procedures and appeals from its decisions shall be governed by the provisions for appeals set forth in the Freedom Building Code (see Chapter 76, Building Construction).
Any person violating any provision of this chapter shall, upon conviction thereof before the District Justice, for each and every such violation, be sentenced to pay a fine not to exceed one thousand dollars ($1,000.) and, in default of payment of such fine and costs, to imprisonment in the county jail not to exceed thirty (30) days. The imposition of one (1) penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each day that prohibited conditions are maintained shall constitute a separate offense.
