It shall be unlawful for any person, persons
or corporation, owners and/or occupiers of land in the Borough of
Marcus Hook, to permit the growth of grass or weeds upon said lands
in excess of six inches in height or to plant or permit to grow any
vegetation to create unpleasant or obnoxious odors or to create or
produce pollen detrimental to the health of any citizen or citizens
of the Borough.

It shall be unlawful for any person, persons or corporation,
owners and/or occupiers of land in the Borough of Marcus Hook to plant
or maintain a vegetable garden in the front, yard of a residential
property.
It shall also be unlawful for any person, persons
or corporation, owners and/or occupiers of land in the Borough of
Marcus Hook, to grow or permit to grow any hedge, bushes or vegetation
which encroaches upon the sidewalk, roadway, lane or streets of the
Borough of Marcus Hook, or to permit any hedge, bushes or vegetation
growing along any sidewalk, street, lane or road in the Borough of
Marcus Hook to exceed four feet in height, or to permit the same to
grow in such a manner as to obstruct the view of vehicles approaching
in the highway.

Any person, persons or corporations violating
the provisions of this chapter shall, upon receipt of five days' notice
from the Code Enforcement Officer or Police Department, remove, cut
or destroy any such grass, weeds or vegetation growing in violation
of the terms of this chapter.

In the event of the refusal of said owners or
occupiers of the land to remove any grass, weeds or vegetation growing
in violation of the terms of this chapter, they shall, upon conviction
thereof, be punishable for each offense by a fine of up to the maximum
amount as provided from time to time by state statute.
In addition to the penalty prescribed in the
foregoing section, the Borough Council of the Borough of Marcus Hook
shall have the right to cut and remove any grass, weeds or vegetation
growing in violation of this chapter after five days' notice has been
served upon the owners and/or occupiers of the property and to file
a municipal lien in the Office of Judicial Support of the Court of
Common Pleas of Delaware County for the cost of the removal of such
grass, weeds or vegetation against the premises violating the provisions
of this chapter, or in the discretion of Council, an action at law
may be commenced against the owners and/or occupiers of land to recover
the costs of the removal of such grass, weeds or vegetation at an
action at law.
