GENERAL REFERENCES
Vehicles and traffic — See Ch. 191.
As used in this chapter, the following terms shall have the meanings indicated:
PARKS
Includes all lands and waters under the control of the Borough of Marcus Hook or that may come under the control while these regulations are in force.
Inasmuch as the parks of the community are for the benefit and pleasure of the whole public, the rules and regulations as set forth in this chapter are for the express purpose of providing for the general welfare of the public using the parks.
The following rules of personal conduct shall apply in Borough parks:
A. 
No person shall commit any disorderly, destructive or immoral act.
B. 
No person shall be intoxicated or have in his possession alcoholic beverages while in the parks.
C. 
Gambling, soliciting or selling of any kind is prohibited, except for concessions authorized by the Borough.
D. 
It is unlawful to cast upon any roadway or park areas paper, bottles, cans or debris of any nature, or otherwise litter premises.
E. 
All persons using the parks, including any bathing areas, must have their bodies concealed by suitable covering.
F. 
Foot traffic in unlighted areas after darkness is prohibited.
G. 
No person shall remove any bench, seat or table or change the location thereof without permission of the Borough.
H. 
No person shall conduct himself so as to annoy any other person.
I. 
No person shall dispose of any waste or garbage except in receptacles designated for the respective purposes. All persons shall dispose of all waste and garbage left by them in such proper receptacles.
No person shall commit any of the following acts within the parks or playgrounds without the previously obtained consent of the Borough:
A. 
Play any music except personal radios at reasonable volume.
B. 
Deliver any public speech.
C. 
Hold any public meeting or engage in any marching or driving as members of a military, political or other organization.
D. 
Post or display any sign, banner or advertisement.
E. 
Conduct any funeral procession or vehicle containing the body of a deceased person.
F. 
Land or launch in any boat at a place not designated by the Borough for that purpose, except in an emergency situation.

G. 
Hold any picnic or build any fire at a place not designated for that purpose unless with written permission.
H. 
Violate the regulations relating to the use of any building or place.
I. 
Injure any notice posted by order of the Borough.
J. 
Digging of any kind.
K. 
Use bow and arrows except where designated.
L. 
Trap or remove any wild animal from any park.
M. 
Allow any animal to enter any park area.

N. 
Remove, cut or damage any flowers, plants or trees from any park.
O. 
Fly any gasoline-driven model airplane except where designated.
P. 
Ride any bicycle within any park area.
Q. 
Strike golf balls.

R. 
Riding of skateboards, roller skating, roller blading or use of scooters (manual or motorized).

S. 
Play ball in Market Square Memorial Park.

T. 
Feed or provide food for any wildlife at any time during the year.

U. 
Use charcoal, propane or electric grill for cooking unless with written permission.

Swim in the Delaware River and Marcus Hook Creek.

W. 
The use of any tobacco product in any form in all Borough parks, playgrounds and recreational fields.

A. 
Only those roadways especially designated and constructed for vehicular traffic shall be used for such.
B. 
The legal speed limit shall be 15 miles per hour on all park roadways. This shall not apply to fire or police vehicles, ambulances nor vehicles used by physicians when actually engaged in responding to emergency calls.
C. 
Automobiles shall park only where space has been provided for that purpose and where posted as such. Parking on grass or on shoulder of roadways is prohibited.
D. 
Minibikes and other two-or-more-wheel motorized conveyances are prohibited.
E. 
Trucks are forbidden in all parks except for deliveries. No trucks weighing over 10,000 pounds shall be permitted.
F. 
Road-testing of all vehicles or driver instruction shall be forbidden in any park.
G. 
Shining of spotlight or any flashlight into any vehicle or at any person from any moving vehicle or fixed position shall be forbidden except by duly authorized personnel.
H. 
Washing, repairing or otherwise servicing of automobiles is prohibited in the parks.
A. 
General regulations for parks are as follows:
(1) 
The parks are closed from 11:00 p.m. until sunrise, or as otherwise posted, and all persons found lounging between these hours may be arrested for trespassing.

(2) 
Children under the age of 18 years not accompanied by a parent or guardian will not be permitted in any park after 9:00 p.m.
(3) 
The Borough Police Department shall be recognized as the agency to enforce the foregoing rules and regulations and to maintain general law.
(4) 
Any group or organization over four individuals must possess an agreement or permit or have obtained authorization from the Recreation and Park Board to assemble in any park or playground.
B. 
The Borough may, at its discretion, levy charges on nonresidents or residents, or both, for the use of park facilities. Charges shall be determined by the Recreation and Park Board and approved by Borough Council.

Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punishable for each offense by a fine of up to the maximum amount provided from time to time by state statute.
