The Code Enforcement Officer is authorized to give any notice, as set
forth herein, by personal service, certified or first class United States
mail, postage prepaid, to the owner or occupant, as the case may be, of any
violation of any provisions of this chapter. Said notice shall be in writing
and may, at the discretion of the Code Enforcement Officer, be by correspondence
or on a citation form prescribed or adopted by the borough.
Any person who violates, fails, neglects or refuses to comply with the
provisions of this chapter shall, upon conviction thereof, be sentenced to
pay a fine to the Borough of Youngwood of not less than $200, nor more than
$500, plus reasonable attorneys fees and costs of prosecution. In default
of such payment, such person shall be imprisoned for a period not to exceed
30 days. Each day's violation shall constitute a separate, punishable
offense, and further notice to the offender shall not be necessary in order
to impose additional fines and penalties.
In addition to, and not in limitation or diminution of any other fines,
penalties or remedies set forth herein, if the owner or occupant of any structure,
building or other property, which has been determined to be dangerous, debilitated,
hazardous or unsafe, as set forth above, fails to complete any designated
repair, correction or removal set forth in any notice, within the time limits
prescribed, the Borough Council of Youngwood, through its Code Enforcement
Officer, shall have the authority to cause such work, repair, correction or
removal to be commenced and/or completed, and the cost and expense thereof,
together with a penalty of 10% added thereto, shall be collected from the
owner of such property, building or structure by any legally authorized means,
including the filing of a municipal claim or lien against the subject property.
Nothing herein shall preclude the borough from pursuing any action at law
or in equity, against the offending person or party, through any court having
jurisdiction thereof, in lieu, in substitution or in addition to the filing
of a municipal claim or lien. All costs and expenses, together with penalties,
including reasonable attorneys fees, are hereby also authorized to be collected
in addition to any other penalties imposed herein.
