Any person or party affected by any notice or citation issued in connection
with this chapter may request a hearing on the matter before the Youngwood
Borough Council, provided that such person or party shall file with the Secretary
of Council a written request for such hearing, within five business days of
the date said notice or citation was mailed or served. The written request
for a hearing shall set forth a brief statement of the grounds or reasons
for the request.
Upon receipt of any written request for a hearing, the Council shall
set a time and place for such hearing, and give the requester, and any other
parties it deems necessary or involved, written notice thereof. At such hearing,
the requestor shall be given an opportunity to be heard and to show cause
why any notice or citation should be modified or withdrawn.
Within 30 days following said hearing, the Borough Council shall either
sustain, modify or withdraw the notice or citation. If Council sustains such
notice, it shall be deemed to be an order, effective as of the date first
issued. If Council modifies any notice or citation, it shall be deemed to
be an order, effective on the date of modification.
No owner's or occupant's obligation to repair, correct or
remove any violation, as set forth on any notice or citation, shall be deemed
to be stayed, postponed or suspended, during the course or pendency of any
appeal set forth herein, unless specifically granted by Council, for cause
shown.
