The Township Administrator shall be appointed by a majority of the Township Committee and shall hold office at the pleasure of the Township Committee. Specific terms and conditions of employment shall be set forth in a written agreement and be approved by resolution of the Township Committee.
The Administrator shall be appointed on the basis of his/her executive and administrative qualifications. Previous responsible, successful experience in local government and municipal management shall be preferred. The Administrator need not be a resident of the Township at the time of appointment and may also thereafter reside outside of the Township.
Pursuant to N.J.S.A. 40A:9-138, the Administrator may be removed from office by a 2/3 vote of the Township Committee. The resolution of removal shall become effective three months after adoption. The Township Committee may provide that the resolution shall have immediate effect; provided, however, that the Committee shall cause to be paid to the Administrator forthwith any unpaid balance of his/her salary and his/her salary for the next three calendar months following adoption of the resolution.
Upon removal, resignation or extended leave of the Administrator, the Mayor, with the advice and consent of the Township Committee, may appoint a temporary Acting Administrator to serve for a period of up to 90 days. Thereafter, depending on the needs of the Township, that appointment may be extended or a new administrator may be appointed pursuant to § 56-7.
Nothing herein shall prevent the Administrator from also holding any other appointive office and fulfilling the duties thereof.
The Administrator shall receive annual compensation as set by the Township Committee.
A. 
The Administrator shall be the Chief Administrative Office of the Township, responsible to the Township Committee for the administration of all Township affairs, and with the following powers and duties to the extent not prohibited by law. He/she shall:
(1) 
Direct and supervise the administration of all departments, offices, and agencies of the Township, except as otherwise provided by law. Department heads shall report to the Township Administrator.
(2) 
As the Township personnel officer, develop, administer and enforce personnel policies adopted by the Township Committee. The Administrator shall have authority to hire, promote, discipline, suspend or discharge employees, except for those for whom the Township Committee is directly responsible, provided that employees covered by other applicable statutes or Township ordinances shall be hired, promoted, disciplined, suspended or discharged in accordance with such laws. The Administrator shall report personnel actions forthwith to the Township Committee.
(3) 
Supervise day-to-day performance of Township employees, assign responsibility for departmental actions and coordinate interdepartmental operations, including those of the Township Attorney, Township Engineer and Township Auditor.
(4) 
Attend all meetings of the Township Committee, except when excused therefrom by the Committee, with the right to participate in discussions but without the right to vote.
(5) 
Prepare and submit to the Township Committee the proposed annual Township budget by requiring and receiving appropriation requests and revenue estimates from the heads of departments, boards, committees, and other appropriate officials, appending thereto a detailed analysis of the various items of expenditure and revenue and such other explanatory comment or statement as he/she may deem desirable.
(6) 
Administer the budget after its adoption, implement the programs contained therein, and enforce financial procedures and policies of the Township.
(7) 
Delegate specific tasks assigned to him/her as he/she deems appropriate; however, responsibility for the assigned work shall remain with the Administrator.
(8) 
Develop procedures for the requisitioning, purchase, inspection, receipt, inventory, distribution, and payment for supplies, materials and equipment. Enforce these procedures upon their adoption by the Township Committee.
(9) 
Review for correctness and recommend all bills and vouchers for payment prior to final approval by the Township Committee.
(10) 
Prepare, or cause to be prepared, specifications and related bid documents or requests for proposals. Bids and proposals are to be received by the Township Clerk and reviewed by the Administrator, who shall make recommendations to the Township Committee.
(11) 
Negotiate, or assist in the negotiation of, contracts for the Township, including insurance contracts, and supervise the performance and faithful execution of such contracts, except insofar as such duties are expressly imposed upon some other Township officer or official by statute or ordinance.
(12) 
Represent the Township in its relations to federal, state and county governments and to other municipalities, and evaluate the Township's interest in contracts, franchises and other business transactions.
(13) 
Maintain a continuing review and analysis of the financial operations, work programs, and costs of municipal services, and keep the Township Committee informed as to the conduct of Township affairs.
(14) 
Prepare, or cause to be prepared, grant applications in favor of the Township, at the direction of the Township Committee.
(15) 
Perform such other duties as may be required by the Township Committee.
B. 
Except for purposes of reasonable inquiry, the Township Committee and its members shall communicate with Township employees only through the Administrator, and shall not give direction to employees other than through him/her.
