[HISTORY: Adopted by the Township Committee of the Township
of Delaware by Ord. No. 1988-10 (Sec. 3-6 of the 1985 Revised General Ordinances). Amendments
noted where applicable.]
As used in this chapter, the following terms shall have the
meanings indicated:
A platform or other board which is mounted on wheels or a
board with roller-skate wheels or other similar wheels affixed to
the underside, having no mechanism or other device with which to steer
or control the direction or movement thereof while being used, operated
or ridden.
No person shall use, operate or ride upon any skateboard on
any public street or public sidewalk within the Township of Delaware.
Any police officer who shall observe any person using, operating
or riding upon a skateboard in violation of this chapter shall take
possession of the skateboard and the same shall be treated as follows:
A.
First offense. Officer will take possession of skateboard, give verbal
warning to juvenile and notify parents of possession. Parents will
be responsible to pick up skateboard at police headquarters.
B.
Second offense. Officer will take possession of skateboard, at which
time it shall be forfeited to the Township of Delaware, and then destroyed
by the Township of Delaware after a period of three months from date
of forfeiture.
C.
Third offense. Officer will take possession of skateboard, at which
time it shall be forfeited to the Township of Delaware, and then destroyed
by the Township of Delaware. A summons shall be issued with a fine
of $25.
D.
Any subsequent offense shall forfeit skateboard to the Township of
Delaware and be destroyed by the Township of Delaware. In addition,
increment in fines of $25 for each additional offense. (Example: $50,
fifth offense, $75.)
