Every owner of a bicycle shall register the same with the Bureau
of Police on a form furnished by the Bureau, which form shall include
the name and address of the owner, the name of the manufacturer of
the bicycle, its frame number or other identification number, if any,
and its style and general description. The registration shall be completed
within 72 hours of the purchase of any bicycle. If the owner of a
bicycle is a minor under the age of 18 years, then a parent, guardian
or person having custody of such minor, or with whom such minor resides,
shall register such bicycle on behalf of the minor owner.
The Bureau of Police or any agency designated by the Bureau
shall issue a registration card and a registration tag of corresponding
number for each registration, which tag shall be suitable for attachment
to the bicycle and which tag shall be attached to the bicycle by the
officer or official issuing the registration tag. The registration
tag shall remain attached to the bicycle to which it was issued during
the period for which such registration shall be effective. It shall
be the duty of the issuing officer or official to compare the serial
number of the bicycle with that given on the application by the owner.
The Bureau of Police shall keep a record of all registrations provided
for herein. The Bureau or its designated agents may refuse to register
any bicycles which are deemed to be in an unsafe mechanical condition.
The fee for the issuance of a registration card and registration
tag shall be $2 for each bicycle. The fee shall be paid to the City
Treasurer at the time of registration. The fee for the issuance of
a duplicate registration card and tag to the registered owner of any
bicycle shall be $1.
It shall be the duty of the operator of any bicycle to display
the owner's registration card, or produce satisfactory proof
that the owner has such a registration card, upon the demand of any
police officer or City official.
Any bicycle being ridden or used upon the streets or public
places of the City or found within the City without a proper registration
tag or with an altered or mutilated serial number shall be subject
to immediate impoundment by the Bureau of Police if probable cause
exists to believe that the bicycle is stolen or not in the possession
of its owner or authorized user.
It shall be the duty of every person who sells or transfers
ownership of any new or used bicycle to report such sale or transfer
to the Bureau of Police within 48 hours of sale or transfer. If such
person has previously registered such bicycle, he or she shall also
return to the Bureau of Police the registration card and tag issued
together with the name and address of the purchaser of such bicycle,
who shall immediately apply for registration of the same in his or
her name.
It shall be the duty of every person who dismantles, reduces
to junk or takes out of operation any bicycle, whether or not the
same is registered, to report the same to the Bureau of Police and
furnish information concerning the same as may be required.
It shall be unlawful for any person willfully or maliciously
to remove, destroy, mutilate, or alter any registration card or registration
tag issued pursuant hereto during the period the same is effective.
In the case of loss or destruction of a registration card or
registration tag, a duplicate registration card and tag shall be issued
to the registered owner upon satisfactory proof of such loss or destruction.
Any bicycle being ridden or used upon the streets or public
places of the City or found within the City without a registration
tag or with an altered or mutilated serial number shall, prima facie,
be considered as being not properly registered and may be immediately
taken and impounded by the Bureau of Police until the person claiming
ownership shall establish his or her right of ownership. The Bureau
of Police shall require such bicycle to be registered properly before
releasing the same to the owner.
The Bureau of Police shall promulgate rules and regulations
governing the administration of this chapter within 30 days of enactment.
Said rules and regulations shall establish hours and places for registration
and shall address any other areas deemed necessary by the Bureau of
Police for the effective enforcement of this chapter. All rules and
regulations established pursuant hereto shall be approved by City
Council.
No operator of any bicycle, when upon the streets of the City,
shall carry any person(s) upon the handlebars or frame of any bicycle,
and no person shall ride in such a manner upon any bicycle.
Every bicycle shall be equipped as required by 75 Pa.C.S.A.
§ 3507.
Whoever violates any provision of this chapter shall upon conviction
thereof be fined not more than $50.
