The purpose of this article is to define and identify the responsible
parties for the cost of installation, modification and/or damage/repair
for the Opticom Priority Traffic Control Systems within the Township
of Howell as follows:
A. New systems. Whenever an intersection requires a traffic signal as
a result of either a residential or commercial building project, the
developer of the project shall be responsible for the cost of installing
the Opticom Priority Traffic Control System, pursuant to the standards
established by the Fire District Commissioner having jurisdiction.
B. Modifications of existing systems. Whenever an intersection equipped
with an Opticom Priority Traffic Control System is modified as a result
of a construction project, roadway realignment or any similar project
that modifies the existing traffic patterns, the agency responsible
for the modifications shall also be responsible for all costs affecting
the Opticom System, including parts, equipment and labor. All modifications
to this system must be approved by the Fire District Commissioner
having jurisdiction.
C. Damage to existing systems. Whenever an existing intersection equipped
with an Opticom Priority Traffic Control System has been damaged as
a result of a motor vehicle accident or incident, the operator of
the vehicle or equipment that is responsible for the damage shall
be liable for all costs to repair the Opticom System back to its original
operating condition. All repairs to the Opticom System must be approved
by the Fire District Commissioner having jurisdiction.
