No person shall operate or cause any vehicle, apparatus or equipment
of any kind or character whatever to be operated upon any of the public
streets within the Borough of Raritan in the County of Somerset in
any manner which will cause or result in mud, earth, gravel, sand,
stone or any other substance or material being deposited or distributed
upon the surface of any such street, whether from the body, wheels,
treads or any other part of any such vehicle, apparatus or equipment.

A. No person shall park or leave unattended any waste or refuse container,
commonly known as a "roll-off dumpster" or "roll-off container," on
or along any public road, street, highway or other thoroughfare, whether
same be controlled by the State of New Jersey, County of Somerset
or Borough of Raritan, within the Borough of Raritan without the written
consent of the appropriate municipal, county or state authority having
jurisdiction over the street, road, highway or public thoroughfare.
Any consent obtained shall be valid and remain in effect for a period
of not more than 30 days, but may be renewed by the appropriate official
upon application.
B. To warn the operators of vehicles of the presence of a traffic hazard
requiring the exercise of unusual care, any roll-off dumpster or roll-off
container parked on or along any street, road, highway or public thoroughfare
shall be equipped with and display markers consisting of all yellow
reflective diamond-shaped panels having a minimum size of 18 inches
by 18 inches. These panels shall be mounted at the edge of the dumpster
or container at both ends nearest the path of passing vehicles and
facing the direction of oncoming traffic. These dumpsters shall have
a minimum mounting height of three feet from the bottom of the panels
to the surface of the roadway.
Any person, corporation or other organization who shall violate
or cause to be violated any of the provisions of this article shall,
upon conviction thereof, be liable to imprisonment in the Somerset
County Jail, or in any place provided by the Borough of Raritan for
the detention of prisoners, for a term not exceeding 90 days or to
a fine not exceeding $200, or both. The court before which any person,
corporation or other organization is convicted of violating any of
the provisions of this article shall have the power to impose any
fine or term of imprisonment not exceeding the maximum fixed in this
article.
Any person convicted of the violation of any of the provisions
of this article may, in the discretion of the court by which he was
convicted and in default of the payment of any fine imposed therefor,
be imprisoned in said county jail or place of detention provided by
the Borough of Raritan for any term not exceeding 90 days.
This article shall take effect immediately upon its adoption
and publication as required by law.
