This article is adopted pursuant to § 10 of the Municipal
Home Rule Law of the State of New York, which empowers a Village to
adopt local laws relating to the membership and composition of its
legislative body and to amend and supersede in its application to
it any provision of the Village Law of the State of New York relating
to the exercise of any powers conferred upon such Board of Trustees
by said § 10 of the Municipal Home Rule Law.
The Board of Trustees of the Village of Medina shall be reduced
in size from six Trustees and one Mayor to four Trustees and one Mayor
pursuant to the provisions of this article.
Inasmuch as § 3-304 of the Village Law of the State
of New York provides for a method of reducing the size of a Village
legislative body that would prematurely terminate the term of office
of three sitting Trustees in potential violation of the Constitution
of the State of New York, this article shall forever amend and supersede
said § 3-304 of the Village Law to the extent it is inconsistent
with any provision of this article.
The reduction in size of the Board of Trustees of the Village
of Medina shall be implemented as follows:
A. At the annual general election for the Village of Medina in the year
2007, there shall be elected one Trustee for a term of two years.
B. At the annual general election for the Village of Medina in the year
2008, there shall be elected three Trustees for the following terms:
(1) Two Trustees each for a term of two years, such positions to be awarded
to the two candidates with highest number of votes.
(2) One Trustee for a term of one year, such position to be awarded to
the candidate with the next highest number of votes.
C. At the annual general election for the Village of Medina in the year
2009, and at every annual general election thereafter, there shall
be elected two Trustees, each for a term of two years.
