The purpose of this chapter is to protect the public health, safety and welfare because of the hazards to the public and the users of skateboards, in-line skates and roller skates, and annoyance to the public in the places that are public or open to the public. The Board of Trustees find that the regulations hereafter enacted are such that are reasonably necessary to accomplish these objectives.
As used in this chapter, the following terms used shall have the meanings indicated:
IN-LINE SKATES
Shoes, skates or footwear with a single row of roller wheels.
ROLLER SKATES
Shoes, skates or footwear with two or more rows of roller wheels.
SKATEBOARD
A narrow board of wood, plastic, fiberglass or similar material with roller skate or other type of wheels attached to each end and used for gliding or moving on any hard surfaces, without a mechanism or other device for steering while being used, operated or ridden.
A. 
No person shall use or operate a skateboard, in-line skates or roller skates upon any public streets (including the entire paved and improved surfaces thereof, including gutter areas, from curb to curb, where curbs exist), within the business district on Main Street between Eagle Street and Starr Street, and on Center Street between West Avenue and State Street;
B. 
No person shall use or operate a skateboard, in-line skates or roller skates upon any public streets (including the entire paved and improved surfaces thereof, including gutter areas, from curb to curb, where curbs exist), sidewalks or on any public lands within the Village of Medina:
(1) 
In a careless manner without due caution and circumspection;
(2) 
While endangering or in any manner to create a risk or danger to any person or property; or
(3) 
In any manner to impede or interfere with pedestrian or vehicular traffic.
A. 
Every person operating a skateboard, in-line skates or roller skates shall operate the same in strict observance of Article 34 of the New York State Vehicle and Traffic Law relating to the operation of bicycles and play vehicles, except as to those provisions which by their nature can have no application.
B. 
The operator of a skateboard, in-line skates or roller skates emerging from any alley, driveway or building shall, upon approaching a sidewalk, yield the right-of-way to all pedestrians on said sidewalk.
C. 
Whenever any person shall operate a skateboard, in-line skates or roller skates upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian.
D. 
No person shall operate a skateboard, in-line skates or roller skates at nighttime unless he or she is wearing reflective clothing, which shall be visible from a distance of not less than 300 feet from the front, side and rear when directly in front of the lawful beams of headlights on a motor vehicle. "Reflective clothing" shall be defined, for the purposes of this chapter, as any shirt, vest or jacket or any other readily visible piece of apparel equipped with a reflective surface.
No parent, guardian or any other person having the legal care, custody or control of any child under the age of 16 years shall allow or permit such child to use or propel any skateboard in violation of §§ 201-3 and 201-4, and such parent, guardian or person having legal care, custody or control shall be subject to the penalties described in § 201-7 of this Code.
In regard to skateboard, in-line skate and roller skate ramps on a public street or sidewalk, if a police officer observes them to be a traffic hazard, he may order their immediate removal, and the violator(s) shall be given the opportunity to remove the ramp to a lawful place. If the ramp is not so removed, or notice cannot be given, for any reason, the Department of Public Works shall remove the ramp and if unclaimed within 10 days thereafter, the ramp shall be deemed abandoned in accordance with the law.
A. 
Where a first violation of this chapter is observed by a police officer, in the first instance, said police officer shall issue a written warning to the violator, and, if said violator is under 16 years of age, said warning shall be issued to his or her parents. A record of said warning shall be kept by the Police Department and a second or more violations will result in a penalty as set forth in Subsections B through D.
B. 
Upon a second violation, the skateboard, in-line skates and/or roller skates shall be confiscated for a minimum period of one week, after which the skateboards, in-line skates and/or roller skates would be returned to the parent or guardian of any minor, or to any person over the age of 16 years of age.
C. 
Upon a third violation, possession of the skateboard, in-line skates and/or roller skates shall be taken for a minimum of two weeks and an appearance ticket issued, which would subject the offender or the offender's parents or guardian, if said offender is under the age of 16 years, to a fine of $25, and upon payment of the fine and expiration of the two-week period, the return of the skateboard, in-line skates and/or roller skates would be made to the parent or guardian of the minor, or, if over the age of 16, to the offender.
D. 
Upon a fourth violation and subsequent violations thereafter, issuance of an appearance ticket to the violator, a fine not to exceed $50, or in lieu of a fine, the presiding justice of the court may impose community service for a period of time upon the violator(s). If a fine is imposed, a parent or guardian shall be so responsible.
