[Adopted 2-9-2006 as Ch. 214 of the 2006 Code of the Borough of High Bridge]
As used in this article, the following terms shall have the meanings indicated:
ALUMINUM BEVERAGE CANS
Used and cleaned beverage cans made entirely of aluminum.
COMMERCIAL DISTRICTS
Those districts known as the DB, ROM and C Districts as same are shown are delineated on the Zoning Map on file in the Clerk’s office.[1]
CORRUGATED BOARD
A material made from pulp and generally containing two sides with a rippled liner between and generally used as an exterior packaging for shipping materials. Expressly excluded are corrugated cardboard products, which have been soiled, chipboard (e.g., cereal boxes) and noncorrugated heavy fiberboard.
GLASS
All cleaned products made from silica or sand, soda ash, and limestone, the product being transparent or translucent, and being used for the packaging or bottling of various materials. Excluded are blue and flat glass (commonly known as window glass), pyrex, drinking glasses, dishes, light bulbs, and ceramics.
LEAVES
The foliage from trees, plants and bushes.
MAGAZINES
Any soft-covered periodical containing miscellaneous articles, stories, poems, and advertisements. This category shall also include brochures, catalogs, and annual corporate reports.
NONRESIDENCES
All commercial, professional, institutional, and industrial premises within the Borough.
OFFICE PAPER
Paper stock which consists of printed or unprinted sheets, shavings, and cuttings of colored or white sulphite or sulphate ledger, bond, writing, and other papers which have a similar fiber and filler content. Also included are computer printout forms, which contain colored stripes and/or impact or nonimpact computer printing. Expressly excluded are carbon paper, envelopes, labels, and paper products, which have been soiled.
POST-CONSUMER PLASTIC BOTTLES
Any plastic bottle generated by a residential, commercial, industrial, and institutional consumer which has served its intended end use. The bottles should be reasonably clean of foreign matter. This includes all plastic bottles or jugs for milk, water, soda, juice, detergents, vitamins, and squeezable mustard and ketchup bottles. Empty motor oil bottles are acceptable if unrinsed with caps put back on. Excluded are dishes, foam products, Saran-type or shrink wrap, and cottage cheese type containers.
RECYCLABLES
For residences, used newspapers; glass; aluminum beverage cans; corrugated board; magazines; leaves; post-consumer plastic bottles; and steel-plated tin and bimetal food and beverage cans as defined above. For nonresidences, recyclables shall mean all items listed for residences plus office paper.
SOLID WASTE
All garbage and rubbish, except recyclables, normally placed at the curb by the residents and commercial occupants of the Borough of High Bridge for regular municipal collection.
TIN-PLATED STEEL AND BIMETAL FOOD AND BEVERAGE CANS
Any steel-bodied food or beverage can, which is either tin coated or has an aluminum top or bottom. All cans should be thoroughly cleaned and labels removed. Excluded are all cans not used for beverage or food such as paint cans, aerosol cans, motor oil cans, etc.
USED NEWSPAPER
Paper of the type commonly referred to as newsprint and distributed at stated intervals, usually daily or weekly having printed thereon news and opinions and containing advertisements and other matters of public interest. This category shall include colored inserts, shiny inserts, and magazines.

A. 
It shall be mandatory for all persons, except those physically disabled, who are owners, lessees, and occupants to separate recyclables from all other solid waste produced by any such residences and nonresidences. It is expressly prohibited and will be determined a violation hereof for any owner, lessee, or occupant of any residential, commercial, or institutional property in the Borough of High Bridge to put recyclables into the solid waste collection system.
B. 
All recyclable material will be prepared for curbside pickup as designated in rules promulgated or agreed to by the Mayor and Council.
C. 
Each recyclable material will be clean and appropriately separated. Additional rules as promulgated or agreed to by the Mayor and Council relating to the condition of the materials must be complied with when materials are left.
D. 
Bundling of newspapers; placement at curb. It shall be mandatory for all persons, except those physically disabled, who are owners, lessees and occupants to separate used newspapers from all other solid waste produced by any such residences and nonresidences and to separately bundle said newspapers for pickup, collection and recycling. Said newspapers shall be compacted and shall be tied or otherwise secured in bundles not exceeding 30 pounds in weight. Such bundles shall be placed separately at the curb for collection at such time as may hereinafter be established by regulation.
E. 
Glass and aluminum shall be commingled in reusable metal or plastic containers not to exceed 35 pounds.
F. 
Corrugated cardboard shall be tied with twine in sections no larger than four feet and not weighing more than 35 pounds.
G. 
Recyclable plastic and tin-plated steel and bimetal food and beverage cans shall be placed in reusable metal or plastic containers not to exceed 35 pounds.
H. 
Recyclables shall be placed at the curb no sooner than 7:00 p.m. the day before the collection and no later than 6:00 a.m. on the day of the collection.
A. 
On and after the date fixed and promulgated by regulation issued by the Mayor and Council of the Borough of High Bridge in accordance with the terms hereof, it shall be mandatory for all sponsors of special events to provide for the following:
(1) 
Compliance with the Board of Health regulations for temporary food sales, if applicable.
(2) 
Adequate quantities of receptacles with heavy-duty plastic liners for both trash and recyclables.
(3) 
Proper labeling of trash and recycling receptacles.
(4) 
Frequent monitoring of trash and recycling receptacles and the transfer of the same when full to separate, closed, centralized containers.
(5) 
Cleanup of the area involved at the conclusion of the special event making sure that all litter is placed in the proper receptacle for either trash or recyclables.
(6) 
Removal of all trash by a licensed solid waste removal contractor at the earliest possible time immediately following the event.
(7) 
Pickup of recyclables or transfer of recyclables to the County Recycling Center.
B. 
The Borough will use Borough personnel to pick up leaves at curbside in the Borough of High Bridge. The leaves to be collected shall be placed at curbside and shall contain no other trash or plant. Additional or amending regulations concerning the pickup of leaves may be established by the Mayor and Council.
From time of placement of recyclables at the curb of any resident or nonresident for collection by the Borough of High Bridge, or its authorized agent, in accordance with the terms hereof, such recyclables shall be and become the property of the Borough of High Bridge. It shall be in violation of this article for any person unauthorized by the Borough of High Bridge to collect or pick up or cause to be collected or picked up any such recyclables. Each such collection in violation hereof from one or more residences shall constitute a separate and distinct offense punishable as hereinafter provided.
The Police Department is hereby authorized and directed to enforce this article. The Mayor and Council will establish and promulgate reasonable regulations as to the manner, days, and times for the collection of recyclables in accordance with the terms hereof. Such regulations shall be promulgated and effective immediately upon adoption and publication as required by law.
A. 
The Borough Council may enter into agreements granting a franchise or license to qualified persons, partnerships, or corporations, to authorize them to collect any or all recyclables at curbside. The Borough Council may enter into agreements to have all recyclables collected at curbside. The Borough Council may, if it elects, use the Borough personnel to collect recyclables at curbside.[1]

B. 
All agreements with qualified personnel collecting recyclables will require the collection of tonnage receipts for all recycling material for yearly report to the State of New Jersey.
Anything herein to the contrary notwithstanding, any person who is an owner, lessee, or occupant may donate or sell recyclables to any person, partnership, or corporation whether operating for profit or not for profit. Said person, partnership, or corporation may not, however, under any circumstances pick up said recyclables from curbside in the Borough of High Bridge if said recyclables are placed at curbside on or immediately preceding the regular curbside collection.
Anything herein to the contrary notwithstanding, any person who is an owner, lessee, or occupant may wrap solid waste in used newspapers and discard same with regular solid waste.
Any commercial, industrial or institutional generator of solid waste within the Borough of High Bridge who has otherwise provided for the recycling of designated recyclable materials shall be except for the provision § 325-19, Effective date and rules, of this article, provided that such generators annually provide to the Borough written documentation as to such existing programs and the total number of tons recycled annually.[1]

Any person, firm, or corporation who violates or neglects to comply with any provision of this article or any regulation promulgated pursuant thereto shall, upon conviction thereof, be punishable as provided in Chapter 1, Article II, General Penalty. Each day such violation and/or neglect is committed or permitted to continue shall constitute a separate offense and be punishable as such.
