This article is a written statement of the smoking policy of the Borough pursuant to N.J.S.A. 26:3D-25.[1]

For the purposes of this article, the following terms shall have the meanings indicated:
BOROUGH MUNICIPAL BUILDING
A building or portion of the municipal building owned by the Borough at 71 Main Street, High Bridge, New Jersey.
HIGH BRIDGE FIRE DEPARTMENT
The building or portion of building occupied by the High Bridge Fire Department as headquarters, which is currently located at 7 Maryland Avenue, High Bridge, New Jersey.
POLICE HEADQUARTERS
The building or portion of building occupied by the High Bridge Police Department as police headquarters, which is currently located at 99 West Main Street, High Bridge, New Jersey.
RESCUE SQUAD HEADQUARTERS
The building or portion of building occupied by the High Bridge Rescue Squad as headquarters, which is currently located at 95 West Main Street, High Bridge, New Jersey.
SMOKING
The burning of a lighted cigar, cigarette, pipe or any other matter or substance which contains tobacco.
A. 
Smoking is prohibited in the Borough Municipal Building and Library located at 71 Main Street, High Bridge, New Jersey. At all entrances to that building and in a location clearly visible to the public at that location, a sign shall be posted with letters at least one inch in height stating "Smoking Prohibited" or the international symbol for "Smoking Prohibited." The sign may also indicate that violators are subject to a fine.
B. 
Smoking prohibitions in Borough police headquarters. Smoking is prohibited in the Borough police headquarters, which is presently located at 99 West Main Street, High Bridge, New Jersey. At all entrances to that building and in a location clearly visible to the public at that location, a sign shall be posted with letters at least one inch in height stating, "Smoking Prohibited" or the international symbol for "Smoking Prohibited." The sign may also indicate that violators are subject to a fine.
C. 
Smoking prohibitions in Rescue Squad headquarters. Smoking is prohibited in the Borough Rescue Squad headquarters, which is presently located at 95 West Main Street, High Bridge, New Jersey. At all entrances to that building and in a location clearly visible to the public at that location, a sign shall be posted with letters at least one inch in height stating, "Smoking Prohibited" or the international symbol for "Smoking Prohibited." The sign may also indicate that violators are subject to a fine.
D. 
Smoking prohibitions in Fire Department headquarters. Smoking is prohibited in the Borough Fire Department headquarters, except the bar area and outside designated areas, which is presently located at 7 Maryland Avenue, High Bridge, New Jersey. At all entrances to that building and in a location clearly visible to the public at that location, a sign shall be posted with letters at least one inch in height stating, "Smoking Prohibited" or the international symbol for "Smoking Prohibited." The sign may also indicate that violators are subject to a fine.
A. 
Any person who violates this article or any of its provisions shall, upon conviction thereof, be punishable as provided in Chapter 1, Article II, General Penalty.[1]

B. 
Any penalty recovered under the provisions of this article shall be recovered by and in the name of Borough High Bridge Board of Health. The penalty recovered shall be deposited into the Treasury of the Borough of High Bridge.
C. 
The North Hunterdon Municipal Court shall have jurisdiction over proceedings to enforce and collect any penalty imposed because of a violation of any provision of this article. The proceedings shall be summary and in accordance with the Penalty Enforcement Law (N.J.S.A. 2A:58-1 et seq.). Process shall be in the nature of a summons or warrant and shall issue only at the suit of the Borough of High Bridge Board of Health.

The following words and terms, when used in this article, shall have the following meanings unless the context clearly indicates otherwise:
MEETING AREA
Any enclosed indoor space in the Borough of High Bridge used for the purpose of holding public meetings to which the general public is allowed to attend.
PUBLIC MEETING
Any meeting conducted in the Borough of High Bridge by any board, commission, committee, agency or department of the Borough of High Bridge, to which the public is invited, allowed or encouraged to attend.
SMOKING
Includes carrying or having in one's possession a lighted cigar, cigarette, pipe or any other lighted smoking equipment.
Smoking shall be prohibited within any meeting area during the time that a public meeting is in progress.
Smoking shall be allowed in designated areas outside of any meeting area in which smoking is prohibited, provided that the ventilation rates for those areas shall be in compliance with applicable state and local construction codes. Such smoking permitted areas shall be outside of the meeting area, clearly accessible to anyone who wishes to smoke, but shall not be in a location which will allow smoke to enter the public meeting area during the time when the public meeting is in progress.
Identification of no-smoking and smoking-permitted areas shall be accomplished by posting in conspicuous places a sufficient number of "No Smoking" and "Smoking Permitted" signs to be supplied by the Board of Health. Public announcement of the smoking restrictions by the presiding Borough official will suffice as notice of the smoking policy only if such announcement is included in the official meeting minutes or tape transcript.
