This article shall be known and may be cited as the "Snow Removal and Street Cleaning Ordinance."
This article is intended to regulate parking of vehicles on the streets of Towanda Borough during and after periods of snowfall to facilitate snow removal from the streets and to regulate said parking during all other times, as necessary, to facilitate street cleaning efforts of the Borough.
A. 
Whenever, in the opinion of the Borough Manager or his designee, as a result of anticipated storms or of snow already on the ground, it is in the best interests of the general public for the purpose of snow removal and reopening of streets that certain parking be prohibited, the Borough Manager or his designee may cause to be temporarily posted, at suitable intervals along any street of the Borough, signs indicating that parking of vehicles is disallowed. Upon the placing of these temporary signs, it shall be unlawful for any person to park or stop any vehicle, except for temporary loading and unloading, along the side of the street so indicated. Such signs shall be placed along the streets at least 12 hours before snow removal efforts shall be undertaken and shall indicate the time after which parking is prohibited. Any vehicle still parked in the prohibited areas shall be subject to the fines and penalties specified in §§ 305-64 and 305-65.
B. 
After the side of the street where parking is prohibited has been cleared of snow, at the direction of the Borough Manager or his designee, the temporary signs may be placed on the opposite side of the street to allow for the removal of snow from that side. Such signs shall also be placed at least 12 hours before snow removal will begin and shall indicate the time after which parking is prohibited. Any vehicle still parked in the prohibited areas shall be subject to the fines and penalties as specified in §§ 305-64 and 305-65.
Whenever, in the opinion of the Borough Manager or his designee, it is in the best interests of the general public to remove dirt, debris, leaves, etc. from the Borough streets, he may cause to be temporarily posted, at suitable intervals along any street of the Borough, signs indicating that parking of vehicles is disallowed. Upon the placing of these temporary signs, it shall be unlawful for any person to park or stop any vehicle, except for temporary loading and unloading, along the side of the street indicated. Such signs shall be placed along the streets at least 12 hours before the Borough's street cleaning efforts shall be undertaken and shall indicate the time after which parking is prohibited. Any vehicle still parked in the prohibited areas shall be subject to the fines and penalties specified in §§ 305-65 and 305-66.
A. 
Whenever, in the opinion of the Mayor or his designee, anticipated storms or snow already on the ground will cause traffic congestion and/or hazards to the public, he may declare a snow emergency.
B. 
Such a snow emergency shall be declared by proclamation and shall be distributed to all the local media, i.e., radio, newspapers and cable television company.
C. 
During a snow emergency so declared, parking will be disallowed along certain designated streets of the Borough where signs have been placed and which bear the words "No Parking During Snow Emergency."
D. 
Depending on weather conditions and/or reports, the snow emergency declaration shall either be rescinded or continued by the Mayor or his designee by additional proclamation within 14 days.
A. 
Upon the declaration of a snow emergency by the Mayor or his designee, it shall be immediately unlawful for any person to park along any street of the Borough where "No Parking During Snow Emergency" signs have been placed.
B. 
Those streets of the Borough so designated shall include:
(1) 
Second Street, along this street's entire length on its west side.
(2) 
Third Street, along this street's entire length on its west side.
(3) 
Orchard Street, along this street's entire length on its west side.
(4) 
Ward Avenue, along this street's entire length on its south side.
(5) 
Chestnut Street, along this street's entire length on its north side.
(6) 
North Main Street, along this street's entire length on its west side.
(7) 
Poplar Street, on its north side between Convent Avenue and Western Avenue.

Any person failing to comply with the provisions of this article shall be liable, upon conviction thereof in a summary proceeding, to pay a fine of $25 plus costs of prosecution for each offense. Each day that a violation continues shall constitute a new offense.
If in the event that an owner of a vehicle parked in a prohibited area cannot be located and it is necessary that the vehicle be moved in order to facilitate snow removal and street cleaning efforts, the Borough Manager or his designee may cause the vehicle to be towed to the nearest available parking place in the neighborhood. All costs of such towing shall be billed by the Borough to the owner of said vehicle. Failure to pay these towing costs shall cause the Borough to recover said costs through any legal means available to it.
