The Town of Hudson has recently undertaken a recycling program
which is a part of its solid waste management efforts. Undertaking
this program involves residents placing their recyclables at curbside,
in designated containers, together with their normal trash, for collection
on the day designated for that section of town where they live. It
has been observed that a person or persons have on occasion taken
these recyclable items placed in front of residences as part of the
town's recycling program. Such actions by that person or persons
greatly inhibit the town's ability to move forward with a successful
recycling program.
From the time of placement of any recyclables at the curb of
any resident, it shall be unlawful for any person, persons, firms
or corporations to collect, remove or dispose of recyclables. Each
such collection, removal or disposal in violation hereof from one
or more residences shall constitute a separate and different offense.
A person, persons, firm or corporation convicted of violating
any provisions of this chapter shall be guilty of a violation, which
is punishable as follows:
A. For a first conviction, by a fine of $25.
B. For a second conviction, by a fine of $50.
C. For a third, and all subsequent convictions, by a fine of not less
than $250 nor more than $500.
