There is hereby established in the Township of Upper Deerfield
a state uniform construction code enforcing agency consisting of a
Construction Official, Building Subcode Official, Electrical Subcode
Official, Plumbing Subcode Official, Fire Protection Subcode Official
and such other subcode officials as may be appointed to administer
additional subcodes hereafter adopted by the Commissioner of the Department
of Community Affairs of the State of New Jersey pursuant to the State
Uniform Construction Code Act.
The Construction Official shall be the chief administrator of
the enforcing agency.
The public shall have the right to do business with the enforcing
agency at one office location during normal business hours, except
for emergencies and unforeseen or unavoidable circumstances.
Appeals from decisions of the enforcing agency shall be taken
to the Construction Board of Appeals duly appointed for the County
of Cumberland pursuant to the provisions of the State Uniform Construction
Code Act.

The fee for a construction permit shall be the sum of the subcode
fees listed in Subsections A through G as set forth herein below.
State Uniform Construction Code enforcing agency.
Construction permits fees. The fee for a construction permit
shall be the sum of the basic construction fee plus all applicable
special fees, and shall be paid before the permit is issued. Each
fee shall be rounded up to the nearest dollar.
A. Plan review fee. The fee for a plan review shall be 20% of the construction
permit fee.
B. Training and certification fees. The Department of Community Affairs
training and certification fees shall be established by the State
of New Jersey under the authority of the New Jersey Administrative
Code to be computed on a per cubic foot volume for new buildings and
additions and for all other construction shall be computed on a dollar
amount per $1,000 of value of construction.
C. Building subcode fees. The building subcode fee shall be:
(1) New construction.
(a)
The fee for new construction shall be $0.034 per cubic foot of volume for buildings and structures, except see Subsection
C(1)(b).
(b)
The fee for new construction with unfinished interiors totaling
50,000 cubic feet of volume shall be $0.018 per cubic foot of volume
for the first 50,000 cubic feet and $0.015 for the remaining cubic
feet, with a minimum fee of $82.
(2) Exceptions:
(a)
For renovation, alterations and repairs, $35 for the first $1,000
of estimated cost and $25 per $1,000 or fraction thereafter.
(b)
Manufactured homes. In accordance with N.J.A.C. 5:23-4.18(c),
there are no fees for the factory-built portion of the home. The fee
shall be $100 per $1,000 of the estimated cost of site construction
associated with the installation of the manufactured home.
(c)
Farm use buildings exclusively used for agriculture purposes
on agricultural assessed land pursuant to N.J.A.C. 5:23-3. The fee
shall be $0.010 per cubic foot of volume of the building or structure,
with a maximum fee of $1,443 per structure.

(3) Combination of renovations and additions. The amount shall be the
sum of the fees computed separately as renovations and additions.
(4) Demolition. Permit fees for demolition of buildings shall be as follows:

(5) Special permits.
(a)
Swimming pools.

The fee for an aboveground swimming pool shall be $125 for a
pool with a surface area greater than 550 square feet; the fee in
all other cases shall be $65.

The fee for an in-ground swimming pool shall be $190 for a pool.
(b)
The permit fee for a permit to construct and install a sign
shall be $4 per square foot, provided that the minimum fee shall be
$70. In the case of double-faced signs, the area of the surface of
only one side of the sign shall be used for purposes of the fee computation.

Relocate building or structure to new location, flat fee of
$300. This subsection is applicable to structures exceeding 300 square
feet, plus applicable special fees.
(f)
Reinstatement of permit, $50 applicable after one year of issuance
date plus volume increase if applicable at time of reinstatement.
(g)
Lead abatement fees: for permit, $100; and for clearance certificate,
$175.
(h)
Asbestos abatement: $175 for permit; and $50 for clearance certificate.
(i)
Application for a variation for all use groups: $750.
(j)
Roofing permits and siding permits: $35 for the first $1,000
and $25 for each additional $1,000.
(k)
The fee for a temporary certificate of occupancy is $35, with
a fee of $30 for each extension.
(6) The minimum construction subcode fee shall be $70.
D. Plumbing subcode fees shall be:

by the Construction Official and the appropriate subcode official.
H. Mechanical inspection fees shall be:

(1) Mechanical inspection in a structure of Group R-3 or R-5 by a mechanical
inspector shall be $70 for the first device and $15 for each additional
device. No separate fee shall be charged for gas, fuel, oil or water
piping connections associated with the mechanical equipment inspection.
The Construction Official shall, with the advice of the subcode
officials, prepare and submit to the Township Committee of the Township
of Upper Deerfield biannually a report recommending a fee schedule
based on the operating expenses of the agency and any other expenses
of the municipality fairly attributable to the enforcement of the
State Uniform Construction Code Act.

No building or structure hereinafter constructed or altered in whole or in part shall be used or occupied until a certificate of occupancy shall be issued by the enforcing agency in accordance with the provisions of the State Uniform Construction Code Act. Copies of all certificates of occupancy or other certifications required to be issued by the Zoning Official or any other public official and affecting the use and occupancy of any building, structure or premises or part thereof shall be filed with the enforcing agency before a certificate of occupancy is issued by said agency. Fees required for a certificate of occupancy shall be those fees fixed in §
303-9, Certificate of occupancy fee, and such fees shall be paid before a certificate of occupancy is issued. No certificate of occupancy shall be issued by the enforcing agency until all of the work covered by the construction permit shall have been completed in accordance with the permit, the State Uniform Construction Code and all other applicable statutes, regulations and ordinances.

A. No single-family, modular home or any other dwelling unit of any
kind shall be moved into the Township of Upper Deerfield for purposes
of permanent location therein, or temporary location therein for more
than 24 hours, without having obtained a moving permit from the Township
Construction Official.
B. Prior to issuance of any moving permit under this section, the Construction
Official shall ascertain that the modular home is either new and not
previously occupied being sold by either a dealer or manufacturer,
or shall ascertain by personal inspection that the modular home or
dwelling unit meets all of the requirement of the International Building
Code (2006 NJ Edition) and the ordinances of the Township of Upper
Deerfield. The Construction Official shall also ascertain that the
modular home or dwelling, irrespective of whether new or used, contains
the certification of New Jersey Department of Community Affairs as
meeting code requirements. After making the determination required
in this section, the Construction Official shall issue a moving permit,
the cost of which shall be $20.
C. Inspections outside of Upper Deerfield Township. All personal inspections provided for under Subsection
B hereof shall be conducted before a modular home or other dwelling physically enters the jurisdiction of the Township of Upper Deerfield. The cost of such inspection shall be borne by the applicant for a moving permit, in addition to the permit fee under Subsection
B, at the following rate: the prevailing mileage reimbursement rate under the Internal Revenue Code per mile for each mile of the round trip to and from the place of inspection plus $75 per hour for time spent by the Construction Official in travel and inspection of the unit involved.
D. No permit shall be issued under this section unless it is determined
by the Construction Official that the applicant therefor has a permanent
location for the modular home or dwelling unit in the Township of
Upper Deerfield on which said unit can be installed in full compliance
with all applicable federal, state and local regulations and has all
permits required therefor.
E. The permit required under this section shall not be required for
the movement of a mobile home, modular home, or other dwelling unit
through Township of Upper Deerfield on a purely transient basis, from
a place outside the Township to a destination outside the Township
on the state highways or county roads within the Township, so long
as such unit does not remain for more than 24 hours in the Township
of Upper Deerfield.
F. Penalties. Violation of any provision of this section shall be punishable
by a fine not to exceed $500, and each day during which a violation
takes place may be deemed a separate violation.
