The Department of Traffic of the Town of Smithtown shall install,
operate and maintain traffic control devices when and as required
under the provisions of this Code to make effective the provisions
of this Code and may install and maintain such additional traffic
control devices as may be deemed necessary for the purpose of regulating,
warning or guiding traffic under the Vehicle and Traffic Law of the
State of New York, subject to the provisions of §§ 1682
and 1684 of that law.

A. Every person convicted of a violation of the Uniform Traffic Code
of the Town of Smithtown shall be punished by a fine not exceeding
$250 or by imprisonment for not more than 15 days, or by both such
fine and imprisonment, for a first conviction. For a second conviction
within 18 months thereafter, such person shall be punished by a fine
of not more than $500 or by imprisonment for not more than 30 days,
or by both such fine and imprisonment. The provisions of this subsection
shall govern unless specifically otherwise provided.

B. Penalties for late payment. If the fines as set forth in §
TC1-5A are not paid on or before the summons return date, a penalty of double the amount of the original fine will be charged, plus an additional penalty of $15 for each successive thirty-day period. Up to a maximum of two successive thirty-day late notices will be assessed for failure to respond to and/or make payment on the original fine plus any penalty so assessed.

C. Charge for insufficient funds. A penalty of $15 shall be charged
to the maker of a check returned for insufficient funds.

D. The fines for violations of the Uniform Traffic Code of the Town
of Smithtown and/or the penalties for failure to pay these fines may
be amended by resolution, from time to time, by the Town Board of
the Town of Smithtown, without the necessity of a formal public hearing.
