As used in this chapter, the following terms shall have the meanings indicated:
ASHES
Residue from fires used for cooking and for heating buildings.
GARBAGE
Wastes resulting from the handling, preparation, cooking and consumption of food; wastes from handling, storage and sale of produce.
REFUSE
Combustible trash, including but not limited to paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture, bedding; noncombustible trash, including but not limited to metals, tin cans, metal furniture, dirt, small quantities of rock and pieces of concrete, glass, crockery, other mineral waste; street rubbish, dirt, contents of litter receptacles, provided that refuse shall not include earth and wastes from building operations, nor shall it include solid wastes resulting from industrial processes and manufacturing operations such as food processing wastes, boiler-house cinders, lumber, scraps and shavings.
It shall be unlawful to place or permit to remain, cause or permit to accumulate, or deposit or permit to fall from any vehicle, any garbage, refuse or ashes on any public or private property in the Borough, provided that this section shall not be construed to prohibit placing garbage, refuse or ashes in a container complying with the provisions of other ordinances of the Borough preparatory to having such material collected and disposed in the manner provided therein.

Any person, firm or corporation who shall violate any provision of this chapter shall be, upon conviction thereof, sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days.

It shall be unlawful to throw, to cast or to leave any rubbish, trash, grass clippings, mud, mulch, dirt or dust or anything whatsoever in any gutter or ditch on or at the side of the highways and streets of this municipality or to permit or to allow any rubbish, trash, grass clippings, mud, mulch, dirt or dust or anything whatsoever to be cast or to be thrown or to be left in any gutter or ditch constructed or maintained on or at the side of the highways and streets of this municipality.
A. 
Offenses defined.
(1) 
Any person who violates any provision of this article is guilty of a summary offense.
(2) 
Each day a violation is continued shall be deemed a separate offense.
B. 
Penalties. A person convicted of an offense under this article shall be sentenced to pay a fine of not less than $300 nor more than $600, plus all costs of prosecution, or, in default of payment, to undergo imprisonment for not less than 10 nor more than 30 days.
