For the purpose of this chapter, the following terms shall have the meanings indicated:
OPERATOR
Includes every individual who shall operate a vehicle as the owner thereof, or as the agent, employee or permittee of the owner, or is in actual physical control of a vehicle.
PARKING METER
Includes any mechanical device or meter not inconsistent with this chapter, placed or erected for the regulation of parking by authority of this chapter. Each parking meter installed shall indicate by proper legend the balance of legal parking time, and at the expiration of such period shall indicate illegal or overtime parking.
PARKING METER ZONE
Includes any restricted street upon which parking meters are installed and in operation.
PARKING SPACE
Any space within a parking meter zone adjacent to a parking meter and which is duly designated for the parking of a single vehicle by lines painted or otherwise durably marked on the curb or on the surface of the street adjacent to or adjoining the parking meters.
PARK or PARKING
The standing of a vehicle, whether occupied or not, upon a street otherwise than temporarily, for the purpose of, and while actually engaged in, receiving or discharging passengers or in obedience to traffic regulations, signs or signals, or an involuntary stopping of the vehicle by reason of causes beyond the control of the operator of the vehicle.
PERSON
Includes any individual, firm, copartnership, association or corporation.
STREET
Any public street, avenue, road, alley, highway, lane, path or other public place located in the Borough of Hanover and established for the use of vehicles.
VEHICLE
Any device in, upon or by which any person or property is or may be transported upon a highway, except a device which is operated upon rails or tracks.

The following names and described areas, streets or portions of streets, and such other areas, streets or portions of streets as may hereafter be included in this section by amendment hereto, lying within the corporate limits of the Borough of Hanover, shall constitute a parking meter zone, and all frontages in said squares, streets or avenues defining said zones shall be included therein:
A. 
On the streets, areas or portions thereof set forth in this subsection, which are hereby designated as parking meter zones, it shall be unlawful for the owner or operator of any motor vehicle or other vehicle to park such vehicle between the hours of 8:30 a.m. and 8:30 p.m. on any day except Sunday for more than 2 1/2 hours at any time, except such spaces as are or shall be designated as cabstands, bus stops, entrances to hotels, theaters, fireplugs and other places where parking is now or may hereafter be prohibited. The parking meters on such streets, areas or portions thereof shall be so set as to display a signal showing legal parking upon the deposit of the appropriate coin(s), lawful money of the United States of America or by use of online digital parking payment service application as approved by Hanover Borough Council with costs as designated by resolution from time to time by Hanover Borough Council, and as referenced in § 254-9 for up to 2 1/2 hours. Each meter by its device shall clearly set out and continue in operation from the time of accepting payment until the expiration of such times will indicate proper signal that the lawful parking period has expired. The foregoing shall apply to the following streets, areas or portions thereof:

B. 
On all designated municipal parking lots, areas or portions thereof set forth in this subsection, which are hereby designated as parking meter zones, it shall be unlawful for the owner or operator of any motor vehicle or other vehicle to park such vehicle between the hours of 8:30 a.m. and 8:30 p.m. on any day except Sunday, for more than 2 1/2 hours at any time in parking spaces where the meter head is painted yellow and for more than 12 hours at any time in all other parking spaces, except such spaces as are or shall be designated as cabstands, bus stops, entrances to hotels, theatres fireplugs and other places where parking is now or may hereafter be prohibited. The parking meters on such streets, areas or portions thereof shall be so set as to display a signal showing legal parking upon the deposit of the appropriate coin(s), lawful money of the United States of America or by use of online digital parking payment service application as approved by Hanover Borough Council with costs as designated by resolution from time to time by Hanover Borough Council for up to 2 1/2 hours where the meter head is painted yellow and up to 12 hours in all other spaces. Each meter by its device shall clearly set out and continue in operation from the time of accepting payment until the expiration of such times will indicate proper signal that the lawful parking period has expired; provided, however, that in parking spaces where the meter head is painted red, parking is permitted up to 10 minutes, without the necessity of payment as hereinabove set forth, only between the hours of 8:00 and 4:30 p.m. on any day except Saturday and Sunday. At all other times and days the parking in such spaces shall be governed by the foregoing regulations applicable to the 12-hour parking spaces.

C. 
On the streets, areas or portions thereof set forth in this subsection, which are hereby designated as parking meter zones, it shall be unlawful for the owner or operator of any motor vehicle or other vehicle to park such vehicle between the hours of 8:30 a.m. and 8:30 p.m. on any day except Sunday and the following legal holidays: New Year's Day, Memorial Day, Fourth of July, Labor Day, Veterans Day, Thanksgiving Day and Christmas Day, for more than 2 1/2 hours at any time in parking spaces where the meter head is painted yellow and for more than 12 hours at any time in all other parking spaces, except such spaces as are or shall be designated as cabstands, bus stops, entrances to hotels, theatres, fireplugs and other places where parking is now or may hereafter be prohibited. The parking meters on such streets, areas or portions thereof shall be so set as to display a signal showing legal parking upon the deposit of the appropriate coin(s), lawful money of the United States of America or by use of online digital parking payment service application as approved by Hanover Borough Council with costs as designated by resolution from time to time by Hanover Borough Council for up to 2 1/2 hours where the meter head is painted yellow and up to 12 hours in all remaining spaces, inclusive, by use of coin or by use of an online digital parking payment service application as approved by Hanover Borough Council. Each meter by its device shall clearly set out and continue in operation from the time of accepting payment until the expiration of such times will indicate proper signal that the lawful parking period has expired; provided, however, that in parking spaces where the meter head is painted red, parking is permitted up to 10 minutes, without the necessity of payment as hereinabove set forth, only between the hours of 8:00 and 4:30 p.m. on any day except Saturday and Sunday. At all other times and days the parking in such spaces shall be governed by the foregoing regulations applicable to the 12-hour parking spaces.

The Borough Manager is hereby directed and authorized to mark off individual parking spaces in the parking meter zones designated and described in § 254-2 of this chapter and in such other zones as may hereafter be established, said parking spaces to be designated by lines painted or durably marked on the curbing or surface of the street. At each space so marked off, it shall be unlawful to park any vehicle in such a way that said vehicle shall not be entirely within the limits of the space so designated. In any parking meter zone where vehicles are now required to be parked parallel to the curbline, parking spaces shall be designated adjacent to the curblines, each of which spaces shall be approximately 22 feet in length. In any parking meter zone where vehicles are now or may hereafter be required to park at right angles to the curbline, parking spaces shall be designated adjacent to the curbline, each of which spaces shall be approximately eight feet in width.

In said parking meter zones, the Borough Manager shall cause parking meters to be installed upon the curb or sidewalk immediately adjacent to the parking spaces provided in § 254-3 of this chapter, as close to the curbline as practical, and the Borough Manager and Chief of Police shall be responsible for the regulation, control, operation, maintenance and use of such parking meters. Each device shall be so set as to display a signal showing legal parking upon the deposit of the appropriate coin(s), lawful money of the United States of America or by use of an online digital parking payment service application as approved by Hanover Borough Council for the period of time prescribed by this chapter. Each device shall be so arranged that, upon the expiration of the lawful time limit, it will indicate by a proper visible signal that the lawful parking period has expired, and in such cases, the right of such vehicle to occupy such space shall cease and the operator, owner, possessor or manager thereof shall be subject to the penalties prescribed by law.

Except in a period of emergency determined by an officer of the Fire or Police Department, or in compliance with the directions of a police officer or traffic control sign or signal, when any vehicle shall be parked in any parking space alongside or next to which a parking meter is located, the operator of such vehicles, shall, upon entering the said parking meter space, immediately deposit or cause to be deposited in said meter the appropriate coin(s), lawful money of the United States of America or by use of online digital parking payment service application as approved by Hanover Borough Council for such parking meter and as is designated by proper directions on the meter, and when required by the directions on the meter, the operator of such vehicle, after making proper payment shall also set in operation the timing mechanism on such meter in accordance with directions properly appearing thereon, and failure to make payment shall constitute a violation of this chapter. Upon making proper payment (and the setting of the timing mechanism when so required), the parking space may be lawfully occupied by such vehicle during the period of time which has been prescribed for the part of the street in which said parking space is located. If said vehicle shall remain parking in any such parking space beyond the parking time set for such parking space, or if the meter shall indicate such illegal parking, then in either event such vehicle shall be considered as parking overtime and beyond the period of legal parking time, and such parking shall be deemed a violation of this chapter.
A. 
It shall be unlawful and a violation of the provisions of this chapter for any person:
(1) 
To cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked overtime or beyond the period of legal parking time established for any parking meter zone as herein described or to deposit in any parking meter a coin for the purpose of parking beyond the maximum legal parking time for the particular parking meter zone.
(2) 
To permit any vehicle to remain or be placed in any parking space adjacent to any parking meter while said meter is displaying a signal indicating that the vehicle occupying such parking space has already been parked beyond the period prescribed for such parking space.
(3) 
To park any vehicle across any line or marking of a parking space or in such position that the vehicle shall not be entirely within the area designated by such lines or markings.
(4) 
To deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this chapter.
(5) 
To deposit or cause to be deposited in any parking meter any slug, device or metal substance or other substitute for lawful coins.
(6) 
To deposit or cause to be deposited in a parking meter any coin for extending the parking time of any parking beyond the time herein provided in a zone in which such meter is located.
B. 
Fines for overtime parking of meters shall be imposed by the Police Department and the parking attendants of the Borough of Hanover as set by Hanover Borough Council resolution from time to time.

The proper officers of the Borough are hereby authorized and directed to enter into contracts for the purchase and installation of parking meters, said contracts to be made subject to the conditions and in the manner provided by law, the payment of such meters and the installation thereof to be provided for solely from the receipts, funds and revenues obtained by the Borough from the operation of said parking meters, without in any manner obligating the Borough to pay for the same from any other sources, and to enter into a contract or contracts for such parts and maintenance of such parking meters as may be necessary to maintain the same in good operating condition and to pay for such parts and maintenance exclusively from the receipts, funds and revenues received from the operation of said parking meters.

Anything to the contrary in this chapter notwithstanding, any person who is in the business of repairing or constructing any property in a parking meter zone, and which requires a vehicle for such work, may obtain from the Police Department a cover or marker, in such form, at such time and for the use of such length of time as the Police Department may determine, which cover or marker, when placed upon or over any parking meter will allow the vehicle of such person to occupy the parking space at such parking meter without payment at the parking meter, provided that such person pay to the Borough of Hanover a sum of money equal to the fee as set by Hanover Borough Council by resolution from time to time for each hour or fraction thereof such space is to be used.

Effective June 12, 2013, the rates and designated times established for parking meter fees shall be set by resolution passed from time to time by the Hanover Borough Council.

A. 
The Borough of Hanover shall make available a parking space convenience pass to be used Monday through Saturday, with the exception of the following legal holidays: New Year's Day, Memorial Day, Fourth of July, Labor Day, Veterans Day, Thanksgiving Day and Christmas Day, but no more than 12 hours out of a twenty-four-hour day, for any twelve-hour metered parking space in a Hanover Borough municipal parking lot as identified on a list of municipal lots on file with the Borough.
(1) 
Such parking passes or permits shall require the execution of a Parking Space Convenience Pass Agreement between the lessee and the Borough of Hanover. The terms of said agreement shall be determined by the Borough Manager upon consultation with the Borough Council, Police Chief and Fire Chief.
(2) 
The Borough shall charge the lessee a rental fee for issuance and use of a parking space convenience pass by Council resolution and may be amended from time to time.
