There is hereby created an Emergency Declaration Fund to provide funding resources for significant emergency-related expenditures which were not anticipated within the Town's General Fund budget and are of an emergency nature.
Contributions to the fund shall be received from:
A. 
Moneys received by the Town from government grants, FEMA payments or loans for emergency management.
B. 
Appropriations made in the annual budget, special appropriations and emergency appropriations consistent with the Town Charter.
C. 
Donations from public and private individuals and entities.
D. 
Any other moneys appropriated to the fund by the Town Council.
The fund shall be in the custody of the Treasurer of the Town of Tolland and all or any part of the moneys in said fund may, from time to time, be invested in any securities in which public funds may lawfully be invested. All income derived from such investments shall be paid into the fund and become a part thereof. The moneys so invested shall at all times be subject to withdrawal for use as provided in § 12-4.
A. 
Emergency-related activities and damages.
(1) 
Moneys paid to the Emergency Declaration Fund and interest earned thereon shall be used solely by the Town for emergency-related activities and damages, provided that all such expenditures shall be approved by the Town Manager. Those related activities and damages are as follows:
(a) 
Wear and tear on equipment and vehicles and repair or replacement of such as a result of emergency-related use.
(b) 
Replacement or repair of infrastructure due to emergency-related damages.
(c) 
Unbudgeted overtime payroll costs related to emergency activities.
(d) 
Service provision by outside professionals to secure public safety.
(e) 
Other emergency-related activities and expenditures as necessary per the recommendation of the Town Manager, Public Works Director and or Director of Public Safety.
(f) 
Expenses incidental to the acquisition of such items may also be paid for from this fund.
(2) 
The Town Manager shall notify the Town Council within a reasonable amount of time after the emergency has occurred regarding the use of this fund for expenditures made.
B. 
Moneys in the fund may be used to provide matching funds for emergency-related programs, if required, by any grants received from the State of Connecticut or federal emergency management programs.
C. 
In the event that the fund balance should build to an excess of $1,000,000, the Town Council may, from time to time, authorize a special appropriation to transfer funds from the Emergency Declaration Fund to the General Fund or other funds by annual budget appropriation or special appropriation consistent with the Town Charter.
D. 
The Town Council, by resolution, must make appropriations to be funded by grants, gifts and any other additional, supplementary and emergency appropriations. The funds which remain at the close of each fiscal year within the Emergency Declaration Fund shall remain in the fund balance of said fund and shall not, therefore, be lapsed to the balance of the General Fund. The Town Treasurer and the Director of Finance shall exercise control and administration of the Emergency Declaration Fund in accordance with their duties under the Town Charter.
