The Town of Tolland and/or Tolland Fire Department Inc. shall
initiate mitigation rates for the delivery of emergency and nonemergency
services by the Fire Department for personnel, supplies and equipment
to the scene of emergency and nonemergency incidents as listed in
Exhibit A. The mitigation rates shall be based on actual costs of
the services and that which is usual, customary and reasonable (UCR)
as shown in Exhibit A, which may include any services, personnel,
supplies, and equipment and with baselines established by addendum
to this article.
A claim shall be filed to the responsible party(s) through their
insurance carrier. In some circumstances, the responsible party(s)
will be billed directly, if the responsible party(s) chooses not to
go through their insurance carrier.

The Fire Department working with the Town Council may make rules
or regulations or add rules and regulations, as not inconsistent with
this section, as they may deem necessary or expedient in respect to
billing for these mitigation rates or the collection thereof. Further,
the Fire Department is authorized to evaluate mitigation fees and
rates on an ongoing basis, and amend or revoke such fees and rates
as they may deem necessary to adjust to industry-wide usual and customary
standards, in respect to billing for their services or the collection
thereof.
