This article shall be known as "A local law to provide for the
reimbursement for actual and necessary expenses incurred by volunteer
firefighters of the Village of Weedsport."
It is the purpose of this article to authorize volunteer firemen
who are members of the Weedsport Fire Department to receive reimbursement
for actual and necessary expenses and/or a mileage allowance for travel
in their own automobiles on Fire Department business.
This article has been adopted pursuant to and in conformity
with Municipal Home Rule Law § 10 and the New York State
Constitution.
The Village of Weedsport (the "Village") hereby authorizes the
reimbursement of actual and necessary expenses and/or a mileage allowance
for travel of the duly designated Fire Chief and Assistant Fire Chief
of the Weedsport Fire Department in their own automobiles on Fire
Department business.
Any and all claims for reimbursement shall be submitted to the
Village Treasurer or Village Clerk upon a proper voucher in accordance
with Village standards and regulations.
The duly designated Fire Chief and Assistant Fire Chief shall
be reimbursed at the then-published standard mileage rate for business
miles driven as determined by the Internal Revenue Service for the
calendar year in which such travel is claimed.
Nothing contained in this article shall be deemed to be an agreement
by the Village to indemnify any act or omission of the Fire Chief,
the Assistant Fire Chief or any other member of the Weedsport Fire
Department during such travel, to the fullest extent permitted by
law, nor shall anything contained herein be deemed to be a waiver
by the Village of any rights of subrogation or any other rights of
the Village to seek indemnification, contribution or comparative fault
for any act or omission of the Fire Chief, the Assistant Fire Chief
or any other member of the Weedsport Fire Department during such travel.
