Recently a proliferation of the use of commercially supplied
temporary storage containers within the Borough's residential
zoning districts has resulted in a deterioration of the aesthetic
qualities of the residential neighborhoods and otherwise adversely
affected the quality of life of those residing in close proximity
of the containers in question. Such quality-of-life issues are especially
impacted in those situations where commercially supplied temporary
storage containers are utilized for a prolonged period of time. The
purpose of this article is to limit the duration of time that such
commercially supplied temporary storage containers may be stored within
the front or side yards of any parcel of real property located within
the Borough's residential zoning districts, and to provide a
permitting fee in connection with the use thereof.
All commercially supplied mobile or temporary storage units
to house or store personal items (inclusive of household belongings,
furnishings and furniture) utilized upon any premises, improved or
otherwise, located within the Borough's residential zoning districts
shall be subject to the following restrictions:
A. Placement and keeping of all such units shall be limited to the paved
driveway located upon the premises.
B. All such units shall be temporary in nature and shall not remain
or be utilized for a period exceeding 60 days. The start date of the
time period shall commence as of the date of the delivery of the regulated
unit, as shown on the delivery ticket issued by the commercial supplier
of the same, which delivery ticket shall be made available to the
Borough's Property Maintenance Office upon request.
C. Utilization of any commercially supplied mobile or temporary storage
units, as defined herein, shall not be permitted on any one parcel
of property located within any of the Borough's residential zoning
districts for more than two sixty-day periods within any period of
12 consecutive months.
D. No commercially supplied mobile or temporary storage units, as defined
herein, shall exceed 16 feet in length.
Utilization of all commercially supplied mobile or temporary storage units defined herein shall be subject to a permitting fee as set forth in Chapter
235, Article
IV, Fee Schedule, for any period of use from one through 60 days.

An article requiring dumpsters and other refuse containers that
are outdoors or exposed to stormwater to be covered at all times and
prohibiting the spilling, dumping, leaking or the otherwise discharge
of liquids, semiliquids or solids from the containers to the municipal
separate storm sewer system(s) operated by the Borough of Lodi and/or
the waters of the state, so as to protect public health, safety and
welfare, and to prescribe penalties for the failure to comply.
For the purpose of this article, the following terms, phrases,
words and their derivations shall have the meanings stated herein
unless their use in the text of this article clearly demonstrates
a different meaning. When not inconsistent with the context, words
used in the present tense include the future, words used in the plural
number include the singular number, and words used in the singular
number include the plural number. The word "shall" is always mandatory
and not merely directory.
MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4)
A conveyance or system of conveyances (including roads with
drainage systems, municipal streets, catch basins, curbs, gutters,
ditches, man-made channels, or storm drains) that is owned or operated
by the Borough of Lodi or other public body and is designed and used
for collecting and conveying stormwater. MS4s do not include combined
sewer systems, which are sewer systems that are designed to carry
sanitary sewerage at all times and to collect and transport stormwater
from streets and other sources.
PERSON
Any individual, corporation, company, partnership, firm,
association or political subdivision of this state subject to municipal
jurisdiction.
REFUSE CONTAINER
Any waste container that a person controls, whether owned,
leased or operated, including dumpsters, trash cans, garbage pails,
and plastic trash bags.
STORMWATER
Water resulting from precipitation (including rain and snow)
that runs off the land's surface, is transmitted to the subsurface,
is captured by separate storm sewers or other sewerage or drainage
facilities, or is conveyed by snow-removal equipment.
WATERS OF THE STATE
The ocean and its estuaries, all springs, streams and bodies
of surface water or groundwater, whether natural or artificial, within
the boundaries of the State of New Jersey or subject to its jurisdiction.
This article shall be enforced by the Police Department and/or
other municipal officials of the Borough of Lodi.
Any person, partnership, association or corporation who or which
shall violate any of the provisions of this article shall be subject
to the following fines or punishment: a fine not exceeding $1,000
and/or a term of imprisonment not to exceed six months and/or a term
of community service not to exceed six months.
