The inhabitants of the Town of Georgetown within the corporate
limits as hereinafter defined in this Charter or as extended as hereinafter
provided are hereby declared to be a body politic incorporated in
law and equity and shall be able and capable to sue and be sued, plead
and be impleaded, answer and be answered, defend and be defended in
all courts of judicature whatsoever by the corporate name of 'Town
of Georgetown.'
The boundaries of the Town of Georgetown are hereby established
and declared as recorded on the official map of record in the Recorder
of Deeds Office for Sussex County in the State of Delaware (official
recorded copies to be kept by the Town Clerk) as presently exists
and as hereinafter amended.
In addition to the aforesaid, the Territorial Limits of the Town of Georgetown shall also include all land annexed by the Town of Georgetown pursuant to Section
1.3 of this Charter. The Council may, at any time hereafter, cause a survey and plot to be made of the Town, and the survey and plot, when made and approved by the Council, shall be recorded in the offices of the Recorder of Deeds in and for Sussex County, State of Delaware, and the same, or the record thereof, or a duly certified copy of said record shall be evidence in all courts of law and equity in this State.
The Town Council of the Town of Georgetown shall have the power
to annex, by ordinance, any territory contiguous to the Town of Georgetown
whenever requested to do so by a majority of property owners of the
area included within the territory proposed to be annexed. Such ordinance
shall: identify criteria for annexation petitions, outline annexation
procedures, requirements for special (referenda) elections, and ensure
an adequate level of service (LOS) is available for area requesting
annexation.
