A. 
Except where specifically defined herein, all words in these regulations shall carry their customary meanings. Words used in the present tense include the future, and the singular includes the plural; the word "lot" includes "plot"; the word "building" includes "structure"; the word "shall" is mandatory; "occupied" or "used" shall be considered as though followed by "or intended, arranged or designed to be used or occupied"; and "person" includes an individual, partnership, association, corporation, company or organization. Where necessary, interpretation as to the precise meaning of any word used in these regulations shall be made, upon application, by the Board of Appeals under its powers of interpretation according to the process hereinafter provided for.
B. 
When used in these regulations, unless otherwise expressly stated or unless the context or subject matter otherwise requires, the following terms shall have the meanings indicated:
ACCESSORY USE OR BUILDING
A use or building customarily incidental and subordinate to the principal use or building, located on the same lot therewith and constructed or improved according to the applicable provisions of the New York State Uniform Fire Prevention and Building Code.
ADDITION
New construction added to an existing building or structure.

ADULT BOOK AND/OR VIDEO STORE
An establishment having a substantial or significant portion (more than 25% of merchandise in number, value or bulk and/or more than 10% of floor area) of its stock and trade books, magazines, periodicals, or other printed or digital matter or photographs, films, videos, slides, or other visual representations, which are characterized by the exposure or emphasis of specified sexual activities or specified anatomical areas or instruments, devices or paraphernalia, which are designed for use in connection with specified sexual activities, which are for sale, rental, viewing on or off the premises.

ADULT ENTERTAINMENT CABARET
A public or private establishment which regularly presents topless and/or bottomless dancers, strippers, waiters, waitresses, male or female impersonators, lingerie models, or exotic dancers, or other similar entertainment or films and motion pictures digitalized CDs or videos, slides, or other photographic material, or which utilizes employees, who as part of their employment, regularly expose patrons to specified sexual activities or specified anatomical areas.

ADULT MODEL STUDIO
Any place where a person who appears in a state of nudity or who displays specified anatomical areas is provided to be observed, sketched, drawn, painted, sculpted, photographed or similarly depicted by other persons who pay money or any form of consideration; are acceptable if duly licensed by the Board of Regents of the State of New York as an educational institution.

ADULT MOTION-PICTURE THEATER
Any motion-picture theater where for any form of consideration, films, motion-pictures, digital CDs, videocassettes, slides or other photographic or digital reproductions are shown, and in which a substantial portion of the total presentation time is devoted to the showing of materials characterized by an emphasis upon the depiction or description of specified sexual activities or specified anatomical areas.

ADULT THEATER
A theater, concert hall, auditorium or similar establishment which for any form of consideration regularly features live performances characterized by the exposure of specified sexual activities or specified anatomical areas.

AIRPORT HAZARD
Any structure, tree or use of land which obstructs the airspace required for or which is otherwise hazardous to the flight of aircraft in landing or taking off at the airport.
AIRPORT, POTSDAM
The Potsdam Damon Field Airport located on Elm Street and Hatch Road.

ALCOHOL
Ethyl alcohol or hydrated oxide of ethyl from whatever source or by whatever process produced.

ALCOHOLIC BEVERAGE
Includes alcohol, spirits, liquor, wine, beer, cider and every liquid or solid containing alcohol, spirits, wine, beer and capable of being consumed by a human being.

ALTERATION, HISTORIC PRESERVATION
Construction or other modification that changes one or more exterior features of a structure or building, but not limited to the erection, construction, reconstruction, addition, sand blasting, water blasting, chemical cleaning or removal of any structure, but not including changes to the color of exterior paint.

ALTERATIONS
As applied to a building or structure, a change or rearrangement in the structural parts or in the entrance or exit facilities or an enlargement, whether by extending on a side or by increasing in height, or the moving from one location or position to another or as stipulated in the New York State Uniform Fire Prevention and Building Code.
ALTERNATE MEMBER
An individual appointed by the Village Mayor to serve on the Village Planning Board or the Village Zoning Board of Appeals when a regular member is unable to participate on an application or matter before the respective board, as provided herein.

ANTENNA
A device used for the transmission or reception of an electromagnetic signal that is mounted to a structure.

APARTMENT
An individual dwelling unit in any building, other than a two-family dwelling, that has more than one dwelling unit.[1]
APPLICANT
Any person, firm, partnership, association, corporation, company or organization of any kind who or which requests the Village Board, the Planning Board or the Zoning Board of Appeals to approve a land use application.[2]

APPLICANT, SEXUALLY ORIENTED BUSINESS
The person applying for a license to conduct a sexually oriented business.

AUXILIARY OFFICE(S)
Room or group of rooms used for administrative, clerical, financial, actuarial, customer service, communications or other similar uses supplementary to the principal public activity of the business. These are commonly referred to as "back offices."

BANNER
Any sign for advertising which is typically exposed to the weather and which is made from cloth, vinyl, canvas or other limp material. See image at Attachment 3.1.6 (reserved) also referred to as a "feather flag." A flag shall not be considered a banner.

BAR OR TAVERN
A business establishment licensed by the State of New York to serve alcoholic beverages and which establishment is designed primarily for the consumption of such alcoholic beverages on the premises, irrespective of whether or not food and/or entertainment are also provided as complementary attractions.
BASEMENT/CELLAR
A story partly underground and having at least half of its clear height above the average level of the adjoining ground.

BED-AND-BREAKFAST
An owner-occupied one-family home in which overnight accommodations are provided or offered for transient guests in return for compensation.

BELT COURSE
A molding or projecting material running horizontally along the face of a building. Belt courses are typically constructed of stone, tile, brick, shingles or similar material.

BICYCLE RACK
A storage stand or rack that is intended to provide short-term bicycle parking commonly referred to as a Class II facility.

BLOCK FRONT
The portion of a block consisting of the properties along one side of a public street between two intersecting public streets on the same side of the street in question.

BUFFER
An area provided to reduce the conflict between two different land uses. Buffers are intended to mitigate undesirable views, noise and glare, to provide greater privacy to neighboring land uses. Typical buffers include, but are not limited to, plant materials, walls, fences, and/or significant land area to separate uses.

BUILDING
Any structure having a roof supported by columns or by walls and intended for the shelter, housing or enclosure of persons, animals or chattel.
BUILDING AREA
The total ground floor area as measured on a horizontal plane at the main grade level between the exterior faces of the walls of the principal building and all accessory buildings, exclusive of uncovered porches, terraces and steps.
BUILDING CONTAINING LICENSED PREMISES
The licensed premises and also any part of a building in which such premises is contained and any part of any other building connected with such building by direct access or a common entrance.

BUILDING FRONT
That side of any building facing a public street as designated on any application for a permit by the applicant; provided, however, that any building shall have only one designated front for the purpose of computing and applying any applicable requirement or standard under these regulations.
BUILDING HEIGHT
The vertical distance measured from the lowest point of the grade plane to the highest point of the structure.

BUILDING LINE
A line parallel to the front, side and rear lot lines, respectively, beyond which a structure may not extend, as determined by the minimum yard requirements for such structure in the applicable zoning district. (See Attachment II-A.[3])
BUILDING, PRINCIPAL
A building in which is conducted the main or principal use of the lot on which said building is situated. Any such building shall be constructed or improved according to the applicable provisions of the New York State Uniform Fire Prevention and Building Code.
BUILDING/USE PERMIT
A document of authorization to construct, repair, alter, enlarge or change the use of any building or property.
BUILD-TO-LINE
A build-to-line defines precisely where at least one exterior wall (generally the front or principal facade) of a proposed building or addition must be located with respect to a street or property line.

BUSINESS OR PROFESSIONAL OFFICE
An office whose primary use is for conduct of a business or a profession.

BUSINESS STREET
A street which services or is designed to serve as an access to abutting business properties.

CAFE
A small, informal establishment that serves a variety of light refreshments.

CANOPY
A projection over a storefront facade, doorway, often decorative or decorated; a roof over an accessory structure, including but not limited to gasoline pumps, and an automated teller machine or drive through window.

CELLAR
A story partly underground and having more than 1/2 of its clear height below the average level of the adjoining ground.
CERTIFICATE OF COMPLIANCE
A document allowing the use or occupancy of a building or property and certifying that the structure or use is in compliance with the requirements of these regulations and all other applicable codes and regulations.
CERTIFICATE OF REGISTRATION
A document denoting and recording such existing situations as are required to apply for and receive certification under the provisions of these regulations.
CLUB, MEMBERSHIP
An organization catering exclusively to members and their guests or premises and buildings for recreational and athletic purposes which are not conducted primarily for gain, provided that there are no vending stands nor merchandising or commercial activities, except as required generally for the membership and purposes of such club. It includes the YMCA, YWCA, YMHA, veteran's organizations, lodges, and religious or similar clubs but does not include fraternities, sororities or other clubs having dormitory accommodations.

COLLECTOR STREET
A street which serves or is designed to serve as a route connecting different parts of the municipality.

COLLOCATION
Locating wireless communication facilities from more than one provider on a single structure.

COMMUNITY CENTER
A public or private meeting hall, place of assembly, museum, art gallery, library or place of further education not operated primarily for profit.
COMPREHENSIVE PLAN
A comprehensive plan for development of the municipality prepared by the Planning Board, pursuant to § 7-722 of the Village Law, and includes any part of such plan separately accepted as a guide or adopted and any amendment to such plan, or parts thereof.

CONFERENCE CENTER
A facility used for business or professional conferences and seminars.

CONVENIENCE STORE
A single-story retail facility of less than 5,000 square feet primarily selling gasoline or other automotive fuels, kerosene or refined petroleum products for home or individual use; and, selling grocery, personal convenience items, delicatessen products, prepared hot and/or cold foods, and facilities for the cleaning of motor vehicles. A bulk fuel depot for the wholesale or retail sale and delivery by truck of home heating or automotive fuels is only permitted for development in the Industrial Zone.

CORNICE
The projection at the top of a wall or the top course or molding of a wall when it serves as a crowning member.

CURB CUT
An interruption to the curb to permit ingress and egress from property to a public right-of-way.

CURB CUT MEASUREMENT
That point as measured horizontally from the curbline of an intersection to a point where the curb height meets the finished surface of the street, or that point measured horizontally from the curbline of the intersection to the edge of a driveway or parking lot curb that is perpendicular to the street.

DEAD-END STREET
A street or a portion of a street with only one vehicular outlet.

DORMITORY
A residence hall providing separate rooms or suites for individuals or for groups of two, three, or four, with common toilet and bathroom facilities but usually without housekeeping facilities.
DRIVE-IN USE
Any commercial or business activity which incorporates as a principal or accessory feature a service window, booth or other like arrangement on the exterior of the building or structure, designed primarily for drive-through or carry-out service.
DRIVEWAY
A private road giving access from a public way to a building on abutting grounds or to a vacant lot. It shall be composed of a minimum of six inches of compacted, stabilized surface consisting of crusher run, crushed stone, blacktop or concrete, or a combination thereof.
DWELLING
A building containing not more than two dwelling units occupied exclusively for residential uses as follows:
(1) 
ONE-FAMILY DWELLINGA building arranged for one dwelling unit.
(2) 
TWO-FAMILY DWELLINGA building arranged for two dwelling units.
DWELLING, GROUP
A building or portion thereof with sleeping and living accommodations for more than five persons, used or occupied as a dormitory, fraternity or sorority house, boardinghouse or rooming house but not as a bed-and-breakfast; or for similar use.

DWELLING, MULTIPLE
Any building:
(1) 
Containing three or more dwelling units.
(2) 
Containing sanitary and sleeping facilities, occupied by one or two families and more than four lodgers residing with either one or both of such families.
(3) 
Occupied or used as a senior citizens home licensed by New York State; or a community residence.
DWELLING, SECTIONAL
Two or more factory-fabricated units which are transported to the site by means other than their own chassis, where they are placed on a permanent foundation and are joined to make a permanent dwelling unit or units. The term "sectional" shall include the term "modular."
DWELLING UNIT
One or more rooms with provisions for living, cooking, sanitary and sleeping facilities arranged for the use of one family.
DWELLING UNIT, ACCESSORY
A dwelling unit located within an existing one-family dwelling that is subordinate and accessory to such use.
EASEMENT
Authorization by a property owner for the use of another and for a specified purpose of any designated part of his property.

ENCLOSED
Contained entirely within a structure.

ENCLOSED MOTOR VEHICLE REPAIR
A building or structure in which a business or service industry involving the maintenance, repair, servicing, inspection or painting of motor vehicles is conducted or rendered.

EXEMPT BUILDING/USE
A minor structure or use that is ancillary to the principal building or use, such as a children's play- or tree house, play equipment, an outdoor barbecue, a wood storage rack, a doghouse and like facilities common to and generally not affecting the principal use of the premises in any significant manner. Such building or use shall not require a permit under these regulations and shall not be counted against the allowable number of or the area to be occupied by accessory buildings or uses.
FACADE
The portion of any exterior elevation on the building extending from grade to the top of the parapet, wall or eaves and extending the entire length of the building facing a front, side or rear line.

FAMILY
One or more persons related by blood, marriage, adoption or guardianship or not more than five unrelated persons occupying a dwelling unit and living as a single housekeeping unit.
FLAG
A rectangular piece of fabric that is used as a symbol of a state or nation.

FLOOD
A general and temporary condition of partial or complete inundation of normally dry land areas from overflow of inland waters and/or unusual accumulation or runoff of surface waters.
FLOOR AREA OF A BUILDING
The sum of the gross horizontal area of the several floors of a building and its accessory buildings on the same lot, excluding cellar and basement floor areas not devoted to residential habitation or customer-related commerce, but including the area of roofed porches and roofed terraces. All dimensions shall be measured between the exterior faces of the walls.
FRATERNITY HOUSE/SORORITY HOUSE
A dwelling occupied as a residence by a fraternity or sorority fully recognized by the State University of New York at Potsdam and/or Clarkson University to include the site at which organization members reside and at which organization members and their guests conduct organization activities, including but not limited to meetings, group business, rushing, pledging, parties and social events. Any such fraternity or sorority house will constitute a group dwelling under the purposes of these regulations.

FRATERNITY/SORORITY
A group or organization of university students established to provide opportunities for its member to be involved in social, academic and other philanthropic or service goals under the auspices of and fully recognized by the State University of New York at Potsdam and/or Clarkson University. Such groups customarily use Greek letters for names but may be otherwise identified.

FULL CUT-OFF OR FULL SHIELD FIXTURE
An outdoor lighting fixture that is shielded or constructed so that all light emitted is projected below a horizontal plane running through the lowest light emitting part of the fixture.

FUNERAL HOME
An establishment with facilities for the preparation of the deceased for burial or cremation, for the viewing of the deceased and for conducting of funerals.

GARAGE, PRIVATE
A deck, building or structure or part thereof used or intended to be used for the parking and storage of vehicles owned and operated by residents of the premises.
GARAGE, PUBLIC
Any garage other than a private garage which is available to the public and is used for the storage, repair, rental, greasing, washing, servicing, adjusting or equipping of automobiles or other motor vehicles.
GASOLINE STATION
An area of land, buildings and structures to be used for the supply of gasoline or other automotive fuel, or refined petroleum products, which may include a convenience store and facilities for cleaning motor vehicles.

GLARE
Direct light that causes annoyance, discomfort or loss in visual performance and visibility.

GROUND FLOOR RESIDENCE
An apartment or residential use on or approximately at the level of the street level floor of a building.

GUIDELINE, HISTORIC PRESERVATION
A guideline is a level that is preferred and recommended, and uses the term "should" and "may." A guideline addresses a specific subject and is a strong suggestion but is not a requirement. Guidelines will be discussed with the Planning Board during site plan review.

HEALTH SERVICES FACILITY
Establishments primarily engaged in furnishing medical, surgical or other services to individuals, including the offices of physicians, dentists and other health practitioners, medical and dental laboratories, out-patient care facilities, blood bank and oxygen and miscellaneous types of medical supplies and services.

HEIGHT OF TOWER
The vertical distance measure in feet from the average existing top of the ground surrounding the tower and within 10 feet thereof to the top point of the tower, including any antenna(s) or other appurtenances. The "existing elevation" shall mean the actual or approved elevation of the property at the time of application.

HOME OCCUPATION
An accessory use customarily conducted entirely within a dwelling by a principal resident thereof, which is clearly secondary to the use of the dwelling for living purposes and does not change the character thereof or have any exterior evidence of such secondary use other than a permitted sign.
HOSPITAL
An institution providing primary health services and medical or surgical care to persons, primarily inpatients, suffering from illness, disease, injury and other abnormal physical or mental conditions, and including related facilities such as laboratories or outpatient, administrative or training facilities.
HOTEL
A facility offering transient lodging accommodations to the general public.
INCUBATOR
A facility which provides operating space and support services to emerging companies.

INSTITUTIONAL USE
Any public or quasi-public not-for-profit facility designed to provide learning, cultural, health, religious or like services.
INTERSECTION
The area embraced within the prolongation or connection of the lateral curblines, or if none, then the lateral boundary lines of the roadways of two streets or highways which join one another at, or approximately at, right angles, or the area within which vehicles traveling upon different streets or highways joining at any other angle may come in conflict.

JUNKYARD
A lot, land or structure or part thereof used primarily for the collecting, storage or sale of wastepaper, rags, scrap metal or discarded material or for the collecting, dismantling, storage and salvaging of machinery or vehicles not in running condition or for the sale of parts thereof.
LANDSCAPED ISLAND
A parking area/lot design feature that may include facilities such as sidewalks to promote pedestrian safety, landscaped strips, islands, perimeter strips or similar features intended to assist in the management of stormwater, facilitate traffic channelization, to control and minimize heat, glare, and increase the supply of oxygen. See 180 Attachments 3.1.1, 3.1.2 and 3.1.3.[4]

LANDSCAPING
The combination of natural elements such as trees, shrubs, ground covers, vines, or other organic and inorganic materials, which are installed for the purposes of creating an attractive and pleasing environment, screening unsightly views, and reducing environmental impacts.

LAND USE APPLICATION
An application for subdivision approval, site plan approval, open development area site plan approval, an area variance, a use variance, a special use permit, a building permit and any additional review for those as needed to comply with the New York State Environmental Quality Review Act; the Environmental Conservation Law, Article 8, and regulations adopted pursuant thereto; and the Village Code, as amended.

LICENSE
A license issued pursuant to Article X, Sexually Oriented Businesses, § 180-47E.

LICENSEE
Any person to whom a license is issued pursuant to Article X, § 180-47E.

LIGHT ASSEMBLY, SERVICE AND REPAIR
A building or part of a building used for the assembly or repair of consumer electronics, household appliances, medical devices and other similar uses, but shall not include motor vehicle repair.

LIGHT FIXTURE
The assembly that holds a lamp and may include an assembly housing, a mounting bracket or pole socket, a lamp holder, a ballast, a reflector or mirror and a refractor or lens. A light fixture also includes the assembly for luminous tube and fluorescent lighting.

LIGHT INDUSTRY
A process of assembly, service or like process conducted within an enclosed structure and subject to the restrictions listed in § 180-16.1A, Purpose.

LOADING SPACE
The area required for loading and unloading of one service vehicle, which in these regulations is held to be 55 feet in length, 12 feet in width and 15 feet in height, not including passageways.

LONG-TERM CARE FACILITY
An institution or distinct part of an institution which is licensed or approved to provide twenty-four-hour health care under medical supervision to two or more patients.
LOT
Any land that is occupied or is to be occupied by a single principal building or use and buildings or uses accessory in nature to the principal building or use, together with such open spaces as are required, having not less than the minimum area, width and depth required for a lot in the district in which such land is situated and having frontage on a street; or such other arrangement as may be determined adequate upon application to and consideration by the Board of Appeals according to the variance procedure established under the regulations.
LOT AREA
The total area within the property lines, excluding any part thereof lying within the boundaries of a public street or proposed public street.
LOT, CORNER
A parcel of land at the junction of and fronting on two or more intersecting streets. Any "corner lot" shall comply with all front yard requirements for each portion of the lot fronting on a street.
LOT COVERAGE
That percentage of the lot area covered by buildings, driveways, parking areas and other impervious surfaces.
LOT, DEPTH OF
The horizontal distance between the front and rear lot lines, measured from the general direction of the side lot lines from the inside edge of the Village right-of-way per Chapter 180, Attachment 2 (II-A).

LOT, INTERIOR
A lot other than a corner lot.
LOT LINES
The property line bounding a lot. Where a property line has been overlain by a dedicated right-of-way for any road or street or has a proposed road or street or has a proposed road or street, the property line shall be deemed to be the street line (see Attachment II-A[5]).

LOT OF RECORD
A parcel of land described and filed as a distinct and separate real property on the latest adopted county tax roll in the office of the St. Lawrence County Clerk on or, in conformity with the requirements herein set forth, subsequent to the effective date of these regulations.
LOT, WIDTH OF
The linear horizontal distance between side lot lines as measured parallel to the street line where such parallel line is a straight line or the chord of such parallel line where it is curvilinear, a distance from the street line equal to the minimum front yard requirement for the zoning district.
MAJOR LANDFORM, ALTERATION OF
The manipulation or movement, whether by dumping, filling or extracting, of an amount of earthen material to a differential of two feet from the natural contour of the land from over an area in excess of 2,500 square feet or 100 linear feet.
MASSING
The three-dimensional shape of a building's height, width and depth.

MASSAGE ESTABLISHMENT
An establishment having a fixed place of business where massages are administered for pay, including but not limited to massage parlors, sauna baths or steam baths. This definition shall not be construed to include a hospital, nursing home or medical clinic or the office of a physician, surgeon, chiropractor, osteopath, duly licensed physical therapist or duly licensed massage therapist or barber shop, beauty salon, athletic club, health club, school, spa or similar establishment where massage or similar manipulation of the human body is offered as an incidental accessory service.

MEMBER
An individual appointed by the Village Mayor to serve on the Village Planning Board or the Village Zoning Board of Appeals pursuant to the provisions of the local laws which first established such Boards.

MOBILE HOME
A factory-finished movable dwelling unit designed and built on a frame and wheels, to be towed on its own chassis to its destination. Only units certified as meeting either the New York State Code for Construction and Installation of Mobile Homes or the United States Department of Housing and Urban Development's Mobile Home Construction and Safety Standards may be located in the Village of Potsdam, and further, any such unit shall bear the required seal noting such compliance.
MOBILE HOME PARK
A property consisting of a tract of land having more than four lots maintained by an operator for mobile homes and/or manufactured homes, and buildings or other structures that may be pertinent to their use, any party of which may be occupied by persons for residential purposes other than recreation, traveling or vacationing, and who are provided services or facilities necessary for their use of the property.

MOTEL
A building or group of buildings where overnight transient guests are lodged for remuneration and which is intended primarily to accommodate the motoring public. This term includes the terms "tourist cabins," "motor hotel" and "tourist court."
MOTOR VEHICLE SALES
An establishment for the display and sale of new and used motor vehicles, recreational vehicles, trailers, mobile homes and boats.
NONCONFORMING BUILDING
A building or structure which does not conform to the requirements for location or dimension of such building or structure in the district in which it is situated as regards minimum yard dimensions, maximum building height or maximum lot coverage.
NONCONFORMING LOT
An existing lot of record on the effective date of these regulations or their applicable amendment, which does not meet the minimum area or dimensions required for a lot in the district in which it is located and where the owner of said lot does not own any adjoining unimproved property, the subdivision of which could create one or more conforming lots.
NONCONFORMING USE
A use of land or a structure which does not comply with all regulations for the district in which it is located, where such use conformed to all applicable laws, ordinances and regulations prior to the effective date of these regulations or their applicable amendment.
OFF-PREMISES WALL-MOUNTED SIGN ADVERTISING NOT-FOR-PROFIT EVENTS
A temporary sign less than 15 square feet in size which is placed in a frame, providing protection from the elements, advertising events sponsored by or benefitting not-for-profit organizations.

OPEN SPACE
A parcel or area of land or water essentially unimproved and set aside, dedicated, designated or reserved for public or private use or enjoyment.
OWNER-OCCUPANT
A person or persons who own a dwelling in fee simple, is a party to a land contract or life estate and who occupy a dwelling as their principal, year-round residence.

PARAPET
The portion of a wall that extends above a building's roof line.

PARK
An area designated for recreational activities oriented to the natural landscape, including hiking, picnic, boating or beach areas and similar outdoor structures and uses.

PARKING AISLE
A passageway for automobiles between established parking stalls in a designated parking area or lot designed to permit the maneuvering of automobiles to and from parking spaces and thence to a public street, highway or right-of-way. The standard width of a parking aisle is 20 feet.

PARKING AREA/LOT
A group of parking spaces and associated travel lanes constituting a designated and improved area composed of a minimum of six inches of compacted, stabilized surface consisting of crusher run, crushed stone, blacktop, concrete, or a combination thereof.
PARKING LOT INTERCONNECTING ROAD
A roadway or driveway of sufficient width to permit the passage of two automobiles connecting parking lots as a means of relieving traffic congestion on major Village thoroughfares.

PARKING OVERLOAD (RESIDENTIAL)
The habitual presence of vehicles parked in a manner or patterns of ingress or egress from an approved parking area that conflicts with a parking plan submitted as an exhibit to an application for a rental housing permit in accordance with § 134-5B(8) or other requirements of § 180-22.

PARKING SPACE/STALL
The area required for parking one automobile, in which these regulations is designated as improved area consisting of a compacted, stabilized surface measuring a minimum of nine and a maximum of 10 feet in width and a minimum of 18 and a maximum of 20 feet in length, not including any required maneuvering aisle or any public street, highway or right-of-way but having direct access to the same.

PEDESTRIAN WALKWAY
A surfaced walkway, separate from the traveled portion of a public or private right-of-way, parking walkway lot or driving aisle.

PEEP SHOWS
A theater which presents materials distinguished or characterized by primary emphasis on matters depicting, describing or relating to specified sexual activities or specified anatomical areas, in the form of live shows, films or videotapes, viewed from an individual enclosure, for which a fee is charged.

PERMEABLE PAVING MATERIALS
Permeable materials for the paving of parking areas slow the flow of runoff allowing it to filter into the soil, sustaining the site's natural hydrological cycles. Examples of permeable paving materials include: concrete pavers, open jointed pavers filled with turf or aggregate, permeable concrete or asphalt.

PERSON
An individual, firm, partnership, corporation, company, association, syndicate or other legal entity, whether he, she or it is acting for himself, herself, or itself or as a servant, employee, agent or representative of another.

PERSONAL SERVICE USE
A business, commercial activity or professional service involving primarily the application of a technical skill or trade in the attention to one's person or personal effects and not involving primarily the sale of merchandise or stock-in-trade.
PLANNING BOARD
The Planning Board of the Village of Potsdam as established by the Village Board of Trustees by local law or ordinance, pursuant to the provisions of § 7-718 of the Village Law.

PRELIMINARY LAYOUT
The preliminary drawing or drawings indicating the proposed manner or layout of the subdivision to be submitted to the Planning Board for its consideration.

PREMISES, LICENSED
The premises licensed pursuant to Article X, § 180-47 and on which a sexually oriented business may be operated.

PROFESSIONAL RESIDENCE-OFFICE
A one-family dwelling in which a resident thereof has a professional office which is clearly secondary to the use of the dwelling for living purposes and does not change the residential character thereof or have any exterior evidence of such secondary use other than a permitted sign.
PROPERTY LOT LINE ADJUSTMENT
A mutually agreed upon relocation of a property line between two adjacent property owners which is not for the purpose of creating a new lot. The property being transferred shall not constitute a lot of division and will be absorbed into the original plat of land. The property lot line adjustment is completed when both the new property descriptions are recorded in the St. Lawrence County Clerk's office.

PUBLIC ASSEMBLY USE
Includes an auditorium, theater, public hall, school hall, meeting hall, church and temple.
PUBLIC OR PRIVATE UTILITY
A structure, use or land designed and maintained as a public, private or municipal utility service facility in the provision of electronic, natural gas, telecommunications, wireless telecommunications, fiber optic cable, radio/television, water and sewer services.

RECREATIONAL VEHICLE
A mobile recreational housekeeping unit, including a travel trailer, pickup camper, converted bus, tent trailer, camper trailer or similar device used for temporary portable housing.
RECREATION, INDOOR
Includes a bowling alley, theater, table tennis, pool hall, skating rink, gymnasium, swimming pool, hobby workshop and similar places of indoor commercial recreation.
RELIGIOUS INSTITUTION
Includes a church, temple, parish house, convent, seminary and retreat house.
RESTAURANT
A business establishment designed for the preparation and serving of food and beverage primarily on the premises, including seating accommodations for all patrons to be served at any one time.
RETAIL TRADE
A business or commercial activity involving primarily the sale of merchandise or stock-in-trade to the public.
ROOMING HOUSE
A dwelling unit operated by a resident occupant and providing a room or rooms for rent, with or without board, to individuals.

SATELLITE DISH ANTENNA
Any parabolic dish, antenna or other device or equipment of whatever nature or kind, the primary purpose of which is to receive wireless telecommunications, radio, television, microwave or other electronic signals from space satellites.

SCALE
The size or proportion of a building element or space relative to the structural or functional dimension of the human body.

SCHOOL
Includes a parochial, private or public school, college, university, day-care facility and accessory uses and shall exclude commercially operated schools of beauty, culture, business, dancing, driving and music and similar establishments.
SETBACK
The required open space between a building line and/or structure and a front, side or back lot line. In the case of front yard setbacks, in this chapter, such setback shall be measured from the curb or the edge of an improved village street.

SEXUALLY ORIENTED BUSINESS
Any commercial activity which sells, rents, shows, exhibits, or makes available for sale or rent, showing, exhibition, any material or entertainment distinguished or characterized by an emphasis on depicting or description of specified anatomical areas or of specified sexual activity and shall include, but not be limited to, adult arcades, adult markets, adult motion-picture theaters, adult theaters and adult video rental sales stores.

SIGN
Any device or marking affixed to, painted on or represented directly or indirectly upon a building, structure or land and which directs attention to an object, product, place, activity, person, institution, organization or business. Each graphic display surface shall be considered to be a "sign." (See Attachment II-B.[6])
SIGN, ADVERTISING OR BILLBOARD
A sign which directs attention to a business, industry, profession, service, commodity or entertainment conducted, sold or offered elsewhere than upon the same lot.
SIGN, ANIMATED
Any sign that uses movement or a change of lighting to depict action or create a special effect or scene.

SIGN AREA
That resultant area determined by circumscribing the exterior sign face with a simple geometric form or forms constituting a single continuous perimeter connecting all extreme points of the sign face. The structure supporting a sign is not included in determining the "sign area" unless the structure is designed in such a way as to form an integral part of or background for the sign face. Only one face of a double-faced sign is included in the computation of the "area" of such sign.
SIGN, BUSINESS
A sign which directs attention to a business, industry, profession, service, commodity or entertainment sold or offered upon the same lot on which it is displayed.
SIGN, CHANGEABLE COPY
A sign or potion thereof with characters, letters, or illustrations that can be changed or rearranged without altering the face or surface of the sign. A sign on which the message changes more than eight times each day shall be considered an animated sign. A sign on which the only copy that changes is an electronic or mechanical indication of time or temperature shall be considered a time-and-temperature portion of a sign and not a changeable copy sign. Changeable copy signs are also referred to as “reader board signs.”

SIGN, EXEMPT
A sign which may be placed without a permit under the provisions of these regulations.
SIGN FACE
Any graphic display surface where a combination of lettering, symbols and lighting constitutes a sign image or message as viewed from the exterior of a building or from the lot line of a parcel of land. Such "sign face" shall include any lettering, symbol, background, border and lighted Plexiglas or plastic directly connected with and an integral part of the signing technique. It shall not include the supporting frame, pole or base structure, provided that such is not designed or featured so as to constitute part of the sign message.
SIGN, FLASHING
Any illuminated sign on which the artificial light is not maintained stationary or constant in intensity and color when such sign is in use. For the purpose of these regulations, any revolving, illuminated sign shall be considered a "flashing sign."
SIGN, FREESTANDING
A sign which is supported by one or more uprights, poles or braces or by a base of wood, metal, stone or concrete in or upon the ground and not attached to a building or other structure.
SIGN, MOBILE
A sign attached to or suspended from any type of motor vehicle or trailer which is capable of being moved from place to place, whether actually moved or not, either under its own power or by attachment to any vehicle and which is intended primarily for the display of advertising messages. Such sign shall not include lettering or other graphics painted or attached flush to the body of service, delivery or other such vehicles, provided that such do not exceed more than six inches beyond the normal body configuration of such vehicles; and, further, that the vehicles are engaged in service or delivery or are stored in the primary residence of a business owner or tradesperson.

SIGN, MULTIPLE TENANT LISTING
A multitenant listing sign is a single sign affixed to the wall of any structure or building in the Central Business District (CBD) which lists the names of businesses sharing the first or second floor footage.

SIGN, NONCONFORMING
A sign which was installed prior to the effective date of these regulations, as amended, and which is in conflict with the provisions hereof.
SIGN, PORTABLE
A sign that is designed to be movable and is not permanently attached to the ground, a building, a structure or any other sign. A "portable sign" shall not be deemed to include a mobile sign.
SIGN, PROJECTING
A sign attached to or suspended from the face of a building or structure, which sign extends more than one foot but not more than four feet as measured from the face of the building or structure.
SIGN, READER BOARD
A sign which is a component of a principal freestanding sign and is typically used to display products and price changes and to announce special promotions.
SIGN, ROOF
A sign located above the cornice and fascia of a peaked or sloping roof or the bottom of a mansard roof per Chapter 180, Attachment 3 (II-B).[7]

SIGN, TEMPORARY
A poster, handbill, flyer or sign erected for a nonpermanent purpose, such as to announce a forthcoming event or for the purpose of sale, rent or project notification, which sign shall be designed to be removed upon completion or termination of the purpose for which it was temporarily placed.
SIGN, TO ERECT
To build, construct, attach, hang, place, paint, suspend or affix a sign.
SIGN, WALL
Any sign attached to, painted upon or erected against the wall of a building or structure and not extending more than the maximum permitted distance beyond the building face.
SIGN, WINDOW
A sign maintained in or painted upon a window which is clearly visible to the general public from an out-of-door position, but not including the customary display of merchandise.
SITE PLAN
The drawings and supplemental information in the form, number and sequence as called for in these regulations for submission to and consideration by the appropriate village body.
SPECIAL FLOOD HAZARD AREA
The land designated by the U.S. Federal Emergency Management Agency subject to a one-percent or greater chance of flooding in any given year.

SPECIAL USE
A use which is permitted in a zoning district, provided that it meets the individual standards and conditions set forth for that use in these regulations. "Special uses" shall not be deemed to constitute uses permitted by right.
SPECIFIED ANATOMICAL AREAS
Less than completely and opaquely covered human genitals, pubic region, buttock, and female breast below a point above the top of the areola; and the male genital in a discernibly turgid state even if completely and opaquely covered.

SPECIFIED SEXUAL ACTIVITIES
Human genitals in a state sexual stimulation of arousal, or acts of human masturbation, sexual intercourse, oral copulation or sodomy; or fondling or other erotic touching of human genitals, pubic region, buttocks or breasts.

STANDARD FOR HISTORIC PRESERVATION
A level that requires conformity and uses the term "shall" or "must." A standard addresses a specific subject and is a requirement. Relief from a standard requires a variance from the Zoning Board of Appeals, unless otherwise stated or the applicant demonstrates that it would clearly be unreasonable or undesirable to do so under all circumstances, in which case the applicant may offer, and the Planning Board or Zoning Board of Appeals may approve, an alternative standard, criterion or action.

STANDARD USE
A use permitted by right in one or more of the respective zoning districts upon application to and issuance of a permit by the Code Enforcement Official in accord with the standards applicable thereto.
STORAGE SHED
A building designed and built for storage purposes as an accessory use to a principal permitted use by the occupants or tenants of said property.

STOREFRONT, HISTORIC
The traditional "Main Street" facade bound by a structural pier on either side, the sidewalk on the bottom and lower edge of the upper facade at the top.

STORY
That portion of a building included between the surface of any floor and the surface of the floor next above it or, if there be no floor above it, then the space between any floor and the ceiling above it.
STORY, HALF
A story under a gable, hip or gambrel roof, the wall plates of which on at least two exterior walls are not more than two feet above the floor of such story.
STREET
A public way which affords the principal means of access to abutting property.
STREET LINE
The line denoting the extent of a public street right-of-way and the lot or property fronting on such public street. (See Attachment II-A.[8])
STREET, MAJOR
For intersections and corner lots, the street carrying the most vehicular traffic as determined by New York State Department of Transportation vehicle count.

SUBDIVIDER
Any person, firm, corporation, partnership or association who shall lay out, for the purpose of sale or development, any subdivision or part thereof, as defined herein, either for himself or others.

SUBDIVISION
The division of any parcel of land into two or more lots.

(1) 
MAJOR SUBDIVISIONThe division of any parcel of land into two or more lots, plots, sites, or other division of land for the purpose, whether immediate or future, of transfer of ownership or building development and shall include resubdivision, whether for sale, rent or development over a period of time.
(2) 
MINOR SUBDIVISIONThe one-time allowance for the division of an improved lot having the customary services of water, sewer, electrical and fronting on an existing paved roadway. The portion of property which is to be separated cannot exceed one acre.
SUBDIVISION PLAT
The final map or drawing on which the subdivider's plan of subdivision is presented to the Planning Board for approval and which if approved will be submitted to County Clerk for recording.

SWIMMING POOL
A pool designed and built for swimming purposes as an accessory use to a principal permitted use for use primarily by the occupants or tenants of said property. Such pool shall include any permanent underground or aboveground pool and any portable pool more than two feet in height or depth and 15 feet in length or diameter.
TELECOMMUNICATION STRUCTURE
A structure, including but not limited to towers or buildings, intended to support wireless communications equipment used to receive and/or transmit electromagnetic waves. Design examples of towers might include but shall not be limited to self-supporting lattice, guyed and monopole structures.[9]

TENANT
A person or persons occupying a dwelling subject to a leasehold.

The visual and tactile quality of a surface apart from its color and form. A building texture refers to the variations in the exterior facade and may be described in terms of roughness or the surface material, the patterns inherent in the material or the patterns in which the material is placed.

UNIVERSALLY ACCESSIBLE PARKING SPACE/STALL
The area required for parking one automobile, which in these regulations is held to be designated as an improved area consisting of a compact, stabilized surface measuring a minimum of 10 feet in width plus an additional access aisle of 60 inches located adjacent to the designated parking space/stall and 20 feet in length, not including any required maneuvering aisle or any public street, highway or right-of-way but having direct access to the same. Such designated spaces shall be identified with an accessible parking space sign and be located on level ground.

UNIVERSALLY ACCESSIBLE VAN PARKING SPACE/STALL
The area required for one automobile, in which these regulations are held to designated as an improved area consisting of a compact, stabilized surface measuring a minimum of 10 feet in width plus an additional 96 inches to accommodate a wheelchair lift mounted to an automobile and having the vertical clearance to accommodate van height at the van parking space, the adjacent access aisle and on the vehicular route to and from the van-accessible space and 20 feet in length, not including any required maneuvering aisle or any public street, highway or right-of-way but having direct access to the same. Such designated spaces shall be identified with a van-accessible parking sign and be located on level ground.

USE
The actual and specific purpose for which a building, structure or land is designed, arranged, intended or for which it is or may be occupied or maintained.
UTILITY AREA
That part of the lot or parcel intended for the placement of public or municipal utilities including water, sewer, electricity, natural gas, telecommunications, and fiber optic cable whether by easement, deed or other conveyance.

VARIANCE
A departure from the provisions of these regulations, authorized and granted by the Board of Appeals, where such variance will not be contrary to the public interest and where, owing to conditions peculiar to the property and not the result of the actions of the applicant, a literal enforcement of the regulations would result in practical difficulty or unnecessary hardship.
VARIANCE, AREA
The authorization by the Zoning Board of Appeals for the use of land in a manner which is not allowed by the dimensional or topographical requirements of the applicable zoning regulations.

The authorization by the Zoning Board of Appeals for the use of land in a manner of for a purpose which is otherwise not allowed or is prohibited by the applicable zoning regulations.

VARIETY STORE
A retail commercial establishment not to exceed 2,000 square feet within an existing building in which goods or materials, such as confections, coffee, soda and assorted snack foods, reading materials, patent medicines and first-aid supplies and similar goods, are offered for sale to the general public; may include the sale of prepared, ready-to-eat foods intended to be consumed off-premises.

WATERCOURSE

Licensed wireless telecommunications services, including, but not necessarily limited to, cellular, personal communications services (PCS), specialized mobile radio (SMR), enhanced specialized mobile radio (ESMR), paging and other types of telecommunications services that are or may be marketed to the general public.

WIRELESS TELECOMMUNICATIONS SITE
A facility operative by a licensed wireless telecommunications service provider which consists of the equipment and structures involved in receiving or transmitting electromagnetic waves associated with wireless telecommunications services.

YARD, FRONT
An open and unoccupied space of a lot facing a street, extending across the front of the lot between the side lot lines and from the outermost front surface of the main building or structure to the front lot line with the minimum distance between the front lot line and the main building line as specified for the zoning district in which the lot is located. A corner lot shall comply with the minimum front yard requirements for each portion of the lot facing the street.

YARD, MINIMUM REAR
An open, unbuilt-upon space on any lot and extending the full width of the lot, the required dimension of which shall be specified for the particular use within each zoning district and which required dimension shall be as measured between the rear lot line and the rear building line. YARD, MINIMUM SIDE
An open, unbuilt-upon space on any lot, the required dimension of which shall be specified for the particular use within each zoning district and which required dimension shall be measured between the side lot line and the side building line and extending from the rear line of the minimum front yard to the front line of the minimum rear yard. (See Attachment II-A.)
ZONING BOARD OF APPEALS
The Zoning Board of Appeals of the Village of Potsdam as established by the Village Board of Trustees by local law or ordinance, pursuant to the provisions of § 7-712 of the Village Law.
