The City does hereby establish a Department of Public Health
in the City, and does hereby create the office of Health Commissioner
of the City, to exercise general supervision of the Department of
Public Health and the public health of the City.

The City Council hereby authorizes the City Manager to enter
into a contract wherein he shall appoint the County Health Commissioner
as Health Commissioner of the City. Such contract shall be with the
County for services of the County Health Commissioner and its Department
of Public Health to perform the duties of the Health Commissioner,
and to be enforcement officer of the City.

A. The Commissioner
of Health shall have general supervision over the public health and
shall see that the laws and ordinances in relation thereto are observed
and enforced. For that purpose the Commissioner is authorized and
empowered, with the approval of the City Council, to make such rules
and regulations as will tend to promote or preserve the health of
the City and carry out the purpose and intents of this Chapter. He
is empowered to authorize and require any employee or Law Enforcement
Officer to enter into and examine premises and ascertain the condition
thereof so far as the public health may be affected by it and to declare
and abate nuisances as provided by this Chapter.
B. The Commissioner
shall keep a record of his acts and orders and shall file in his office
all petitions, documents and papers belonging thereto. Copies of such
records, petitions, documents and papers when certified by him shall
be prima facie evidence in any court of the facts therein contained.
