The Chief of Police shall be a qualified voter of the City and
a resident thereof for one (1) year next preceding his/her appointment
and shall have attained the age of twenty-one (21) years.

There is hereby created the office of Chief of Police in and
for the City.

The Chief of Police shall be appointed by the Mayor with the
approval of the City Council.

The Chief of Police shall receive an annual salary which shall
be established by ordinance, payable monthly, in full compensation
for all services rendered as Chief of Police.

A. The Chief
of Police shall have and perform the following duties:
1. To see
that all ordinances of the City are faithfully and rigorously enforced
and to arrest forthwith and bring before the Municipal Judge any person
who shall commit any violation of this Chapter, the ordinances of
the City or the laws of the State.
2. To arrest
and bring before the Municipal Judge or commit to the City prison
or some other place of safe keeping any person charged with violation
of this Code, State law or City ordinances.
3. To execute
all processes of the Municipal Court.
4. To hold
in custody all persons upon whom fines or costs may have been imposed
by the Municipal Court for such period as may be prescribed by this
Code or City ordinance or the judgment of the Municipal Court or until
the same be paid.
5. To be
the Chief Administrative Official of the Police Department.

The Chief of Police shall make full settlement with the City
Council at the end of each fiscal quarter of all matters between him/her
and the City and such other settlements as may be required by the
Council, this Code or by ordinance.

A. The Chief
of Police is hereby given the authority within his/her sole discretion
to suspend any officer or employee within his/her department to include
Police Officers, communications personnel, meter and parking attendants
and clerical personnel for cause, the general good of the department
or the individual officer involved.
B. Said
suspension may be with or without pay, at the discretion of the Chief
of Police.
C. Any such
suspension shall be effected by a personal interview with the Chief
of Police wherein a written notification of said suspension and the
terms thereof is delivered to the person to be suspended. Suspension
shall be effective according to the terms of the written notice thereof;
provided however, that the Chief of Police may order an immediate
suspension on oral order, written notice thereof to be provided the
person to be suspended within twenty-four (24) hours thereafter.
D. Upon
the exercise of this authority, the Chief of Police shall at the next
regularly scheduled meeting of the City Council after exercise of
said authority present to the Mayor and Council a written report of
the actions taken by the Chief and the reasons therefore with recommendations
to the Council on any permanent action to be taken by the Council
with regard to the person suspended.
E. The Council
may ratify the actions of the Chief of Police in said suspension and
approve his/her recommendations or modify his/her recommendations
or, if more time is necessary to investigate the facts and circumstances
giving rise to the suspension, may withhold action for such time as
is necessary to determine the facts.
F. Any disciplinary
action taken by the City Council shall be made in conformity with
the Personnel Policies Handbook of the City of Chillicothe, Missouri.

In the event that there is not a Chief of Police currently holding
office, all references and powers of said Chief of Police set forth
in any ordinance shall include the Director of Law Enforcement Services.
