A.
The
City of Chillicothe parks and recreation rules and regulations are
hereby adopted as the official regulation of conduct within all City
parks and recreation facilities:
1.
Maximum speed limit is fifteen (15) miles per hour.
2.
Pedestrians have the right-of-way at all times. All vehicles must
stop for pedestrians in crosswalks.
3.
Camping is not allowed except with the written consent of the Parks
and Recreation Board.
4.
Commercial truck traffic and parking is prohibited, unless delivering
products to the Parks and Recreation Department.
5.
Automobiles, motorcycles, trucks, golf carts and all other gas-powered
or electric-powered motorized vehicles are prohibited on park grounds
except on designated roadways and parking areas.
6.
All parks shall be open to the public at 6:00 A.M. daily and close
at 10:30 P.M. daily.
No one shall enter onto or remain on any parks and recreation
facility or use any equipment, fields, buildings, pavilions, walking
trails or parking areas after the hours of closing with the following
exceptions:
a.
The downtown green space shall close at 7:30 P.M. daily.
b.
The tennis courts, volleyball courts, ball fields and parking areas
immediately adjacent to these areas shall remain open to persons using
these facilities until 11:30 P.M. daily except in cases of special
events approved in advance by the Parks and Recreation Department
and/or the Parks and Recreation Board.
c.
Walking trails and adjacent parking areas will be open at 5:00 A.M.
to 11:30 P.M. daily.
d.
Parks may be used after closing in cases approved in advance by the
Parks and Recreation Department and Parks and Recreation Board.
e.
Pavilions are operated on a first-come, first-serve basis. Persons
wishing to reserve a shelter may remain on park grounds after hours.
Any person or persons reserving a facility shall remain in that pavilion
and not use other facilities on the park grounds.
7.
No one shall leave unattended, without permission from the Parks
and Recreation Director or Chillicothe Police Department, any motor
vehicle, motorcycle, truck, car, van, or any other gas-powered, electrical-powered
or motorized vehicle after the park and recreational facility's closing
hours. Violators are subject to towing at the owner's expense and
impoundment and a ticket for illegal parking.
8.
All parks and recreational facilities of the City are to be
drug-free locations. No person shall consume, use, abuse, possess,
transport, distribute or supply any alcoholic beverages, illegal narcotics
or drugs, or prescription drugs without a proper prescription, at
any time in any City park or recreational facility, except that:

9.
Unauthorized sales and/or solicitations within park grounds are prohibited
without the written consent of the Parks and Recreation Board.
10.
All trash and other refuse shall be placed in proper receptacles
provided for in the park. Littering is prohibited. Please keep the
parks clean.
11.
Such other park facility rules, as adopted by the Parks and Recreation
Board and posted within the park, must be observed.
12.
No structures, buildings, monuments, signage or other improvements
of any type or kind shall be constructed or placed within a park except
with the prior approval of the Parks and Recreation Board.
13.
No person shall smoke on or within twenty-five (25) feet of a park
standard while a sporting event, game or practice is in progress on
the field for which the standard services.
14.
No horseback riding on park grounds. No unleashed animals, except
in designated areas.
15.
It is unlawful for any person or persons to injure, molest, maim,
wound or kill any bird or animal in any park facility.
16.
No one shall take, remove, carry away or transport any piece or part
of a City park and recreation facility equipment, building, structure,
walking trail, parking area, field or otherwise.

It shall be unlawful for any person or persons to injure, molest,
maim, wound or kill any bird or animal in Simpson Park, June Shaffer
Memorial Park, Mills Park, Clay Street Park or Gravesville Park.

A.
The
Parks Department shall charge a fee of twenty-five dollars ($25.00)
to any person or entity wishing to reserve a shelter house within
the City's park system. Said fee shall permit a shelter house to be
reserved for four (4) hours. Additional hours shall require a fee
of five dollars ($5.00) per hour.
B.
The
Park Board shall adopt a written policy concerning the manner in which
shelter houses may be reserved including restrictions of limitations
thereon.

The Tree Advisory Board shall establish a list of official tree
species acceptable for planting as street trees, divided into three
(3) categories of trees based on average height of each tree at maturity
with those categories being small, medium and large trees. The list
constitutes the official street tree species list for the City. Any
tree not appearing on the official street tree species list may be
planted as a street tree as long as the maturity height is less than
twenty-five (25) feet.

A.
Unless
pre-approved in writing by the Tree Advisory Board:
1.
All street trees appearing on the small tree official street tree
species list shall be planted at least thirty (30) feet apart.
2.
All street trees appearing on the medium tree official street tree
species list shall be planted at least forty (40) feet apart.
3.
All street trees appearing on the large tree official street tree
species list shall be planted at least fifty (50) feet apart.

A.
Unless
pre-approved in writing by the Tree Advisory Board:
1.
All street trees appearing on the small tree official street tree
species list shall be planted at least five (5) feet from the curb,
curb line and sidewalks.
2.
All street trees appearing on the medium tree official street tree
species list shall be planted at least ten (10) feet from the curb,
curb line and sidewalks.
3.
All street trees appearing on the large tree official street tree
species list shall be planted at least fifteen (15) feet from the
curb, curb line and sidewalks.

No street tree shall be planted closer than thirty-five (35)
feet to any street corner, measured from the point of the nearest
intersection curbs or curb lines.

No street tree shall be planted closer than ten (10) feet to
any fire hydrant.

No street tree other than those species listed as small trees
in the official street species list shall be planted under or within
ten (10) lateral feet of any overhead utility wire or over or within
five (5) lateral feet of any underground water line, sewer line, transmission
line or other utility without prior written approval of the Chillicothe
Municipal Utilities General Manager.

A.
The
City shall have the right to plant, prune, maintain and remove trees,
plants and shrubs within the rights-of-way of any City street, alley,
avenue, lanes, sidewalks, squares and public grounds as may be necessary
to insure public safety or to preserve or enhance the symmetry and
beauty of such public grounds.
B.
The
City may remove or cause or order to be removed any tree or part thereof
which is in an unsafe condition or which by reason of its nature is
injurious to sewers, electric power lines, gas lines, water lines
or other public improvements or is affected with any injurious fungus,
insect or other pest.
C.
Nothing
herein shall be construed to prevent adjacent property owners from
planting, in compliance with the applicable City ordinances, street
trees in public rights-of-way.

No person, firm, department or City employee shall top any street
or park tree or other tree on public property without prior written
approval of the Tree Advisory Board.

Property owners abutting public rights-of-way shall maintain
trees, shrubs and other woody vegetation within such rights-of-way
in a manner which promotes safe and healthy plants and which protects
the health, safety and welfare of the public.

All stumps of street trees and park trees shall be removed below
the surface of the ground so that the top of the stump shall not project
above the surface of the ground.

No person shall prevent, delay or interfere with the City or
any of its agents or contractors while engaging in and about the planting,
cultivating, mulching, pruning, spraying or removing any street tree
or park tree.
