A. 
It shall be an ordinance violation for any person over the age of eighteen (18) years, a corporation or other business entity to carry on or engage in within the City limits for the purpose of receiving remuneration, profit or pay any of the occupations, trades, businesses, avocations, agencies or other businesses mentioned or referred to in this Chapter without securing a license therefor, and paying the license fee therefore, as provided for by this Chapter.
B. 
A person found guilty of violation of an ordinance in this Chapter shall be punished as provided in Section 100.340 of this Code of Ordinances of the City of Chillicothe, Missouri.

A. 
Applicants for a license hereunder must file with the City Treasurer a sworn application in writing, on a form to be furnished, which shall include the following information:
1. 
Name and description of the applicant;
2. 
Address (legal and local);
3. 
A brief description of the nature of business and, if applicable, the goods to be sold;
4. 
If employed, the name and address of the employer, together with credentials establishing the exact relationship;
5. 
The length of time for which the right to do business is desired;
6. 
If a vehicle is to be used, a description of the same, together with license number thereof;
7. 
A copy of applicant's State retail sales license (if applicable) or Interstate Commerce Commission exemption certificate (if applicable);
8. 
Two (2) sources of identification of applicant, including either applicant's operator's license or Social Security number;
9. 
A statement as to whether applicant has ever been convicted of any violations of laws or ordinance of this or any other State or municipality other than a traffic violation;
10. 
A certificate of insurance for Workers' Compensation insurance coverage if the applicant is required by Chapter 287, RSMo., or other applicable State law to have said coverage or a statement by the applicant that applicant is exempt by State law from providing said insurance coverage.

A. 
Upon receipt of such application, the City Treasurer shall review the information contained therein and shall, with the exception noted in Subsection (B) hereof, determine in each case whether the license to do business shall be issued. If the applicant is found to be unsatisfactory, the City Treasurer shall endorse on such application his/her disapproval and his/her reasons therefore and shall notify the applicant that his/her application is disapproved and that no license will be issued. If the applicant is found to be satisfactory, the City Treasurer shall, upon payment of the prescribed license fee, deliver to the applicant the license for the carrying on of the business applied for.
B. 
In all cases, the City reserves the right to request that the Police Department check into the applicant's background. A written waiver by the applicant of any objection to such background check shall be prerequisite to the issuance of a license.
C. 
Upon approval by the City Treasurer of such application and upon payment of the fees as set forth below, a license to do business shall be issued to the applicant by the City Treasurer.

Any person aggrieved by the action of the City Treasurer in the denial of an application for license as provided in Sections 605.020 and 605.030 of this Chapter shall have the right of appeal to the City Council of the City of Chillicothe, Missouri. Such appeal shall be taken by filing with the City Council, within seven (7) days after notice of the action complained of has been mailed to such person's last known address, a written statement setting forth fully the grounds for the appeal. The City Council shall set a time and place for a hearing on such appeal and notice of such hearing shall be made, postage prepaid, to the licensee at the address set forth in his/her notice of appeal at least five (5) days prior to the date set for hearing. The decision and order of the City Council on such appeal shall be final and conclusive.

Any person who shall exercise, carry on or engage in any of the following businesses, trades, avocations, pursuits and professions or occupations shall first pay the fees hereby taxed as a license tax against the same, to wit:

No home-based business shall be required to obtain a business license. A home-based business must obtain a State sales tax and pay City retail merchant tax if applicable to the type of business.

No license shall be issued prior to the passage of twenty-four (24) hours from the time of submittal of the application.

The City Treasurer shall keep a record of all licenses issued. In addition, the City Treasurer shall keep a record of any complaints against any person licensed under the provisions of this Chapter and of any convictions for violations of this Chapter.

All licenses issued hereunder shall be carefully preserved and prominently displayed in a conspicuous manner in the place of business authorized to be conducted by said license.

When any person is engaged in more than one (1) occupation, trade, business or avocation and the same are subject to the provisions of this Chapter, then that person shall be required to pay the license tax imposed by this Chapter on each such occupation, trade, business or avocation.

A. 
Licenses issued under the provisions of this Chapter may be revoked by the City Council of the City of Chillicothe, after notice and hearing, for any of the following causes:
1. 
Fraud, misrepresentation or false statement contained in the application for license;
2. 
Fraud, misrepresentation or false statement made in the course of carrying on the business;
3. 
Any violation of an ordinance of the City of Chillicothe, Missouri, or State or Federal law;
4. 
Otherwise conducting the business in an unlawful or unethical manner or in such manner as to constitute a breach of the peace or to constitute a menace to the health, safety or general welfare of the public.
Notice of hearing for revocation of a license shall be given in writing setting forth specifically the grounds of complaint and the time and place of hearing. Such notice shall be mailed, postage prepaid, to the licensee at his/her last known address at least five (5) days prior to the date set for hearing.
A. 
No person following for a livelihood the profession or calling of minister of the gospel, duly accredited Christian Science practitioner, teacher, professor in a college, priest, lawyer, certified public accountant, dentist, chiropractor, optometrist, chiropodist, or physician or surgeon in this City shall be taxed or made liable to pay any municipal or other corporation tax or license fee of any description whatever for the privilege of following or carrying on such profession or calling, and after December 31, 2003, no investment funds service corporation as defined in Section 143.451, RSMo., may be required to pay any such license fee in excess of twenty-five thousand dollars ($25,000.00) annually, any law, ordinance or Charter to the contrary notwithstanding.
B. 
No person following for a livelihood the profession of insurance agent or broker, veterinarian, architect, professional engineer, land surveyor, auctioneer, or real estate broker or salesman in this City shall be taxed or made liable to pay any municipal or other corporation tax or license fee for the privilege of following or carrying on his/her profession unless that person maintains a business office within the City of Chillicothe.

All licenses provided for herein shall be renewed annually. The license period shall be from April first (1st) through March thirty-first (31st) of each year. For those licensees that have been in business continually for the one (1) year period immediately preceding the renewal date, no new application need be submitted to the City Clerk for such licensees; a new license will be issued upon payment of the required fee as set forth above. Otherwise the application procedure set forth above must be followed.

Any person who, in making the application for license required in Section 605.020 hereof, shall make a false declaration of the information required in said application shall be guilty of an offense and shall be subject to a fine as set forth in 100.340 of this Code.

Any person, including all employees of any person, who shall be found guilty of engaging in business within the corporate limits of the City of Chillicothe, Missouri, without first obtaining a license therefore as required by this Chapter shall be subject to a fine as set forth in 100.340 of this Code.

No person shall be granted a license under the provisions of this Chapter unless such person shall have met all State and Federal requirements.

Nothing contained herein shall be deemed to create or constitute a cause of action against the City of Chillicothe, Missouri, in regard to the issuance or non-issuance of any license for failure to provide evidence of Workers' Compensation coverage.
