There is hereby established in and for the City an executive department to be known as the Board of Public Works.

The Board of Public Works shall be composed of four (4) persons, electors of this City, who have resided herein for a period of at least two (2) years preceding their appointment.

The members of the Board of Public Works shall be appointed by the Mayor and confirmed by the City Council.

Not more than two (2) members of the Board of Public Works shall belong to the same political party and its administration shall in all respects be entirely non-partisan.

The members of the Board of Public Works shall hold office for a term of four (4) years each and until their successors are appointed and qualified; provided that the first (1st) incumbents of said Board of Public Works shall be appointed and hold office for the terms of one (1), two (2), three (3) and four (4) years respectively. Provided that in no event shall any citizen member of the Board be reappointed to serve more than two (2) consecutive four (4) year terms.

Any member of the Board of Public Works who shall accept a nomination for any other office during his/her official term shall be deemed thereby to have resigned as a member of said Board and his/her said membership shall thereby be ipso facto vacated.

In case of removal by death, or otherwise, a vacancy exists in the Board of Public Works, such vacancy shall be filled in the same manner as original appointments are made, but the vacancy shall be filled only for the unexpired term of such vacating member.

The Board of Public Works shall meet at least twice in each month at its office. Three (3) members of said Board shall constitute a quorum.

There shall be a President, Vice President and Secretary of the Board of Public Works who shall be appointed by said Board and at its pleasure be removed. Said officers shall be selected from the members of the Board of Public Works.

The Board of Public Works may employ a General Manager and such subordinates, including engineers, inspectors, clerks, firefighters and assistants, and the number of such appointees and the compensation thereof shall be authorized by the Board of Public Works. Said Board shall have the right to remove said General Manager and subordinates by a vote of three-fourths (¾) of said Board.

All bills of the Board and all salaries of its employees shall be passed upon by the Board of Public Works and approved by them and the amounts thereof certified to the City Council and shall be paid in the same manner as the salaries of other officers and employees of the City and other bills of the City are paid.

The Board of Public Works shall have the power and it shall be its duty to take charge of and exercise control over the electric light and power facility, water facility, waste water facility, refuse and Internet type services or facilities of the City, and shall assess light and power, water, waste water, refuse and internet rates and enter into contracts for light and power, water, waste water, refuse and internet type services and facilities and collect the revenue therefrom and shall enforce the performance of all the contracts and work and have the charge and custody of all books, property and assets belonging or appertaining to such electric light and power facility, water facility, waste water facility, refuse department, and internet type services or facilities. The Board shall have the power and authority to provide internet type services or facilities.

The Board of Public Works shall have the authority to establish by rule or regulation such standards and specifications as may be deemed necessary for the installation, construction and maintenance of any utility service system owned and operated by the City within or without the City and under the management of the Board. Such rules, regulations, standards and specifications shall be filed in the office of the City Clerk-Treasurer. Violation of such rules, regulations, standards and specifications shall be deemed a violation of an ordinance.

It shall be the duty of the Board of Public Works to keep books of accounts showing with entire accuracy contemporaneous current entries of the receipts and expenditures of the Board in such manner as to enable the same to be understood and investigated and also to preserve on file in its office in duplicate vouchers for all its expenditures, which books and duplicates shall, at all times, be open to the examination of the Finance Committee of the City Council and such Board shall, through its Secretary, make monthly, quarterly and annual reports of its financial affairs and shall cause the said annual report to be published in the official organ of the City.

All contracts and official acts of the Board of Public Works shall be signed by the President or by two (2) members of the Board and attested under the hand of the Secretary.

The Board of Public Works shall purchase all supplies and materials used by the City in the Electric Light and Power, Water, Wastewater and Refuse Departments and in all other municipally-owned plants.

A. 
The Board of Public Works will transfer to the General Fund from the electric, sewer, water, and trash service funds an amount equal to eight percent (8.00%) of the gross receipts by such funds derived from all sales of electric, water, sewer, and trash utility services, subject to the following modifications and exclusions:
1. 
Sales of electricity, water, sewer, and trash utility service to a customer classified by the Utility Department at the location served as an industrial customer when the industrial classified customer at the location is primarily in the business of manufacturing, industrial fabricating, industrial assembling, industrial processing, industrial warehousing, or wholesale distribution, will be subject to a reduced rate of three percent (3%) of gross utility sales to such location.
2. 
All sales to MO PEP are excluded.
3. 
Wholesale sales of utilities are excluded.
4. 
Sales of trash bags for non-recyclable items are excluded.
5. 
Interdepartmental sales to Departments of the City are excluded.
B. 
All funds shall be transferred in monthly installments within thirty (30) days after the end of each month.
C. 
The funds transferred shall be distributed to the General Fund of the City and then allocated to the Departments pursuant to the adopted budget of the City.
D. 
These fund transfers amounts may be included and stated separately on customer bills. For purposes of identification on such bills the transfer fee amount will be called a "PILOT FEE."
The Utility Department will advise its customers that the PILOT FEE replaces the property taxes and franchise fees that the City's General Fund would receive if the utilities were owned and the utility service provided by an investor-owned utility, and the fund transfer assists in covering a part of the cost for the use of City streets, rights-of-way, and other City property for utility purposes, the cost of providing fire and police protection for the utility facilities, and represents a modest return to the General Fund of the City of a part of the profits of the Utility Department for the City's investment in the Utilities Department which General Fund is used to pay for the cost of police, fire, parks, streets and other operations of the City.
