The City Administrator shall be the Chief Administrative Officer of the City Government, shall enforce the laws of the City and require the faithful performance of all administrative duties. He/she may serve as the head of any department other than the Department of Law.

A. 
The City Administrator shall:
1. 
Appoint, dismiss, etc. With the approval of the majority of the City Council, appoint all department heads except the City Attorney, City Clerk and Municipal Judge. He/she shall appoint competent, qualified officers and employees to the administrative service and shall have the power to dismiss, suspend and discipline, in accordance with Chapter 130, of all officers and employees in the administrative service under his/her control. He/she shall also have the power to authorize a department head or officer responsible to him/her to appoint and remove subordinates serving under that department head or officer.
2. 
Administration. Be responsible for the day-to-day administrative activities of the City. He/she shall also serve as the professional staff resource to the Mayor and the City Council in matters concerning the proposal and development of major public policy.
3. 
Appoint to acting capacity. Designate himself/herself or some other officer or employee to perform the duties of any office or position in the administrative service under his/her control which is vacant or which lacks administration due to the absence or disability of the incumbent.
4. 
Annual report. Prepare and present pursuant to Section 5.4(f) of the City Charter to the City Council an annual report.
5. 
Annual budget activities. Assemble estimates of the financial needs and resources of the City for each ensuing year, prepare a program of activities within the financial power of the City and shall prepare and submit a recommended annual budget and five (5) year capital program for review and approval pursuant to the City Charter.
6. 
Assign according to classification. Have the power to assign any employee of the City to any department or branch thereof requiring services appropriate to the personnel code classification of the employee so assigned.
7. 
Prescribe rules. Have the power to prescribe such rules and regulations as he/she shall deem necessary or expedient for the conduct of administrative agencies subject to his/her authority and he/she shall have the power to revoke, suspend or amend any rule or regulation of the administrative service so prescribed by himself/herself or subordinates.

Investigate. Have the power, either by himself/herself or by an officer or person designated for the purpose by him/her, to investigate and to examine or inquire into the affairs or operation of any department, division, bureau or office; and when so authorized by the City Council, he/she shall have power to employ consultants and professional counsel to aid in such investigations, examinations or inquiries.
9. 
Overrule officials. Have the power to set aside any action taken by a department head and may supersede the department head in the functions of his/her office.
10. 
Delegate duties. Have the power to direct any department, division or bureau to perform the work for any other department, division or bureau.
11. 
Authority to make emergency regulations. The City Administrator or his/her designated representative is hereby empowered to make and enforce temporary regulations to cover emergencies which threaten the health, welfare or safety of the public, provided that such temporary regulations shall not be enforceable by citation after the emergency has passed or subsided to a point where the health, welfare or safety of the public is no longer threatened or for longer than ninety (90) days.
12. 
Appear before City Council. Attend City Council meetings and have the right to take part in discussion but may not vote. He/she shall receive notice of all special meetings.
13. 
Other duties. Serve as City Traffic Engineer and perform such other duties as are specified in the City Charter.
