No persons under the age established by law for the consumption
of alcoholic beverage shall be present on any premises licensed for
the on-premises consumption of alcoholic beverages during the hours
that establishment is open for the sale or dispensing of alcoholic
beverages except as follows:
A. An establishment that is primarily a restaurant with drink services
may permit underage persons, accompanied by an adult, to be served
food and nonalcoholic beverage at a table, provided that there is
no public bar or, if a public bar is present, that the public bar
be definitively separated from the restaurant area by a wall or other
barrier and those persons using the rest room facilities are not required
to traverse the public bar area to reach these facilities; provided,
further, that no underage persons shall be found on said premises
after 10:00 p.m. Sunday through Thursday and 11:00 p.m. on Friday
and Saturday.
B. An establishment which is primarily a banquet or catering facility
where no public barroom exists or a licensed establishment which is
entirely rented out for a private social or fund-raising event, provided
that there is no access to the general public during the duration
of the event.
C. Persons who are lawfully employed by the establishment or who possess
an ownership interest in the establishment, provided that the name
of the person appears on the mandatory employee list kept by the license
holder or the licensee application filed by the license holder with
the Office of the Municipal Clerk.
