It shall be unlawful to sell or distribute alcoholic beverages
within the Borough without a license.
The Council of the Borough shall constitute the authority for
the administration of the issuance of the licenses under this article,
and the Clerk of the Borough is authorized and empowered to issue
licenses for the sale and distribution of alcoholic beverages in the
Borough when such licenses shall have been approved.
All applications for licenses or for renewals of licenses or
for transfer from place to place or person to person shall be made
as required by law and the state rules and regulations.
In accordance with N.J.S.A. 33:1-12, the fees for alcoholic beverage licenses shall be as provided in Chapter
34, Fees, §
34-7.
There shall be no more than five plenary retail consumption
licenses, three plenary retail distribution licenses and three club
licenses permitted in the Borough.
It is hereby determined that no seasonal retail consumption
license or limited retail distribution license shall be issued in
the Borough.
No plenary retail consumption license or plenary retail distribution
license, except renewals for premises licensed prior to July 1, 1966,
and transfers from person to person, shall be granted or transferred
to other premises within 1,000 feet from existing licensed premises
covered by either a plenary retail consumption license or a plenary
retail distribution license, except that this limitation shall not
apply to a transfer of a plenary retail distribution license existing
on July 1, 1966, to a new licensed premises located within 1,000 feet
of a plenary retail consumption licensed premises.
In addition to the penalties provided in §
1-2 of this Code for violations of this chapter, the license issued pursuant to this article may be suspended or revoked for violation of any provision of this chapter or for violation of any provisions of Chapter
1 of Title 33 of the New Jersey Statutes Annotated or of any of the rules and regulations promulgated by the Director of Alcoholic Beverage Control.
