The provisions of this chapter shall be solely applicable to cases falling outside the jurisdiction of Chapter 24, Stormwater Management, Chapter 17, Land Development Review, and Chapter 28, Zoning.
It shall be unlawful for any person to erect or construct or install a drainage ditch, culvert, drainpipe, bridge or any other type of drainage structure or obstruction affecting the drainage of any premises in the Borough without first obtaining approval therefor from either the Director of Engineering and Development by administrative determination or the Planning Board.
A. 
Applications for permission required under § 234-2 shall be submitted, in writing, to the Director of Engineering and Development and shall include the following:
(1) 
A map or diagram of the property, with the location of all present or proposed ditches, streams, brooks, pipes and drainage structures.
(2) 
Elevations based on United States Coast and Geodetic Survey datum of all such features shown, combined with stormwater standards and procedures. (See Chapter 24, Stormwater Management.)
(3) 
The percent of grade of the flow line of the proposed drainage structure, pipe or other construction.
(4) 
The disposition which will be made of the water being drained or channeled from the premises.
B. 
In passing upon such application, the Director of Engineering and Development may administratively approve the application upon recommendation of the Borough Engineer or refer such application to the Planning Board for such disposition for emergency maintenance for all drainage structures which drain water off the premises of the applicant or an easement over or under a public road, street or right-of-way.
C. 
Should public property be affected thereby, the approval shall likewise be obtained from the Borough Council.
The application under § 234-3 shall be immediately referred to the Planning Board Engineer or other authority designated by the Borough Planning Board. The application and site shall be examined by such Engineer or authority and a full report shall be made to the Planning Board. The report shall deal particularly with the adequacy of the proposal from an engineering standpoint and shall take into full consideration the effect of the same on the overall drainage for the area. The report shall also contain the specific recommendation of the Engineer and shall be rendered, if possible, at the next subsequent meeting of the Planning Board.
In passing upon an application under § 234-3, the Borough Planning Board shall require that all drainage structures which drain water off the premises of the applicant shall be extended and tied into storm drains, ditches or other existing publicly owned or controlled drainage for the area. It shall also require that the pipe or structure is of sufficient size and installed to the proper grade, taking into consideration the size of the area to be drained. If all standards are complied with and the drainage structure meets good construction and engineering practice, approval shall be granted by the Planning Board or the Director of Engineering and Development upon written concurrence of the Borough Engineer.
All drainage ditches, culverts, drains, pipes and drainage structures shall be kept open and free flowing at all times, and it shall be unlawful for any person to throw or place any debris or material of any manner whatsoever or to cause such to be thrown or placed into any drainage ditch or drainage structure under the control of the Borough or any municipal, county, state or federal governmental agency.
