There is hereby established in the Borough a Municipal Court, pursuant to N.J.S.A. 2B:12-1 et seq.

The name of the Municipal Court shall be "Municipal Court of the Borough of Lincoln Park in the County of Morris," and the Municipal Court shall have such criminal, traffic and civil jurisdiction as provided by law.

A. 
The Municipal Court shall have a Judge, who shall be known as the "Judge of the Municipal Court," who shall have such qualifications as may be provided by law.
B. 
The Judge of the Municipal Court shall be appointed by the Mayor, with the advice and consent of the Borough Council, and shall serve for a term of three years from the date of his appointment, until his successor is appointed and qualifies.
C. 
The Judge of the Municipal Court shall, before entering upon the duties of his office, take and subscribe to an oath, as provided by law, and in accordance with Court Rule 7:14-5.[1]

D. 
His salary shall be such as the Borough Council may, from time to time, determine, and the salary shall be in lieu of any and all fees and costs.
E. 
Whenever the Judge of the Municipal Court shall be unable to sit as such, he may designate any other cross-assigned Judge of any Municipal Court in the Morris/Sussex vicinage to sit for him temporarily and hold the Municipal Court, provided that any such designation shall be in accordance with the vicinage cross-assignment order of the Assignment Judge.[2]

The Administrator and Deputy Administrator of the Municipal Court shall be appointed by the Council following the hiring process provided in Rule 1:34-3 of the New Jersey Rules of Court, with compensation to be fixed by ordinance.

The Borough Council shall provide the necessary accommodations for the Municipal Court and shall furnish a Court Seal as required by law, as well as other necessary supplies.
Anything in this chapter to the contrary notwithstanding, the duties, powers and jurisdiction of the Municipal Court and the Judge thereof shall be such as shall, from time to time, be prescribed or established by law and the rules of the State Supreme Court, and this chapter shall, at times, be subject to any provisions of law and the rules of the Supreme Court affecting the duties, powers and jurisdiction of the Court or the Judge.
