The erection (including excavation), demolition, alteration, construction or repairing of any building or the excavation of streets or highways or construction or excavation for site development other than between the hours of 7:00 a.m. and 7:00 p.m. on weekdays and 8:00 a.m. and 7:00 p.m. on Saturdays shall be prohibited. Such construction activities shall, likewise, be prohibited on the following major holidays: New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving and Christmas.

A. 
Notwithstanding the foregoing, in the event of urgent necessity in the interest of public health and safety, the Borough Engineer is authorized to issue a temporary permit for such construction activity on the prohibited days and during the prohibited periods.
B. 
Exempted from the foregoing shall be state, county and municipal governments and their agencies, together with public utilities.

Any person violating any provision of this chapter shall, upon conviction, be subject to the fines and penalties set forth in § 1-2 of this Code (general penalty), in the discretion of the judge imposing the same. A separate offense shall be deemed committed on each day on which a violation occurs or continues.
