As used in this Chapter, the following terms shall have these
prescribed meanings:
REGULAR POLICE OFFICER
A member of the Police Force who performs general Police
duties during his/her entire working time.

There is hereby established in the City, a Police Department
which may consist of a Chief of Police, Captain, Lieutenants, Sergeants,
Corporals and as many other full-time Police Officers as necessary
for the proper and efficient policing of the City. The Board of Aldermen,
with the recommendation of the Board of Public Safety may determine
by resolution the number of regular Police Officers in the Department.

The Chief of Police may promulgate rules and regulations for
the governing of the Police Department and the members or employees
thereof. The Mayor and Board of Aldermen may, from time to time, amend
or repeal such rule, rules or regulations or adopt a new rule, rules
or regulations.
The Board of Aldermen shall be authorized to employ one (1)
or more full-time regular Police Officers as may from time to time
be determined necessary for the proper and efficient policing of the
City; provided however, that the Mayor, with the recommendation of
the Chief of Police, may temporarily fill vacancies in the Police
Department without the approval of the Board of Aldermen. Such interim
or temporary employment shall not exceed thirty (30) days and is intended
to be for a sufficient period of time to permit the Board to consider
making the Mayor's action permanent or taking other action.
Compensation of the regular Police Officers of the City shall
be as provided by the Board of Aldermen.

The Mayor and Board of Aldermen of the City may from time to
time or on a permanent basis provide for basic or supplemental police
and fire protection services by contract with St. Louis County or
other Municipalities as they shall deem necessary by Ordinance of
the City properly adopted.

A. Definitions. For the purpose of this Section, the following
words and phrases shall have the meanings respectively ascribed to
them by this Section:
EMERGENCY SITUATION
Any situation in which the Peace Officer has a reasonable
belief that a crime is about to be committed, is being committed,
or has been committed involving injury or threat of injury to any
person, property, or governmental interest and his/her response is
reasonably necessary to prevent or end such emergency situation or
mitigate the likelihood of injury involved in such emergency situation.
The determination of the existence of any emergency situation shall
be in the discretion of the Peace Officer making the response or in
the discretion of a Peace Officer or Governmental Officer of the political
subdivision in which the emergency situation is alleged to be occurring.
MUNICIPAL POLICE OFFICER
Any Police Officer of the City of Warson Woods, Missouri,
who has completed the basic police training program when required
by Chapter 590, RSMo., excluding reserve officers.
RESPONSE
To take any and all action which the Peace Officer may lawfully
take as if exercising his/her powers within his/her own jurisdiction.
B. A Municipal
Police Officer of the City of Warson Woods, Missouri, shall have the
authority in accordance with the departmental procedures to respond
to an emergency situation outside he/she boundaries of the City of
Warson Woods, Missouri, while on duty.
C. The authority
contained herein shall permit the response by one (1) or more Municipal
Police Officers to an emergency situation within any incorporated
area whose corporate limits are common with the City of Warson Woods,
Missouri, or within a two (2) mile radius from the corporate limits
of the City of Warson Woods, Missouri. The Chief of the Police Department
or his/her designee may in his/her discretion authorize additional
response beyond this designated area.
D. Police
Officers shall not leave the City inhabitants with inadequate police
protection or be absent for extended periods of time. The response
shall be in aid of, and to assist, the authorities of the County or
the Municipality in which the emergency situation is located. No Police
Officer of the City shall be authorized to make an arrest by reason
of this authorization to respond, nor shall he/she be authorized to
use his/her weapon except to respond to a threat of serious physical
harm to himself/herself or others or to make an arrest for a felony
violation involving the infliction or threatened infliction of serious
physical harm.
E. Every
response to an emergency situation outside the City's boundaries shall
be reported by the Police Officer(s) to the Chief of Police who in
turn shall notify the Mayor with a written explanation for the reason
for said response.
F. Under the authority set forth in Section 70.837, RSMo., and in addition to the authority granted in Subsections
(B) through
(E) of this Section and Section
200.070, the Chief of Police is authorized to direct any Municipal Police Officer to respond and provide assistance to any other public safety agency in Missouri or any bordering State at the time of a significant emergency, such as a fire, earthquake, flood, tornado, hazardous material incident or other such disaster. Assistance will be provided pursuant to this Subsection only if the Governing Body of the public safety agency to be assisted has mutual aid legislation allowing that public safety agency to provide similar aid to the public safety agencies of the City. All the restrictions in Subsections
(D) and
(E) of this Section and all provisions of law applicable to actions by Municipal Police Officers within the City shall apply to any assistance provided outside the City by any Municipal Police Officer pursuant to this Subsection.

A. The Officers
of the City of Warson Woods Police Department are authorized to participate
in and cooperate with any Law Enforcement Officers of jurisdictions
in any Major Case Squad operation or formation. The Officers designated
to act in the Major Case Squad operation will be so designated by
the Chief of Police and when acting outside of the City of Warson
Woods as a member of the Major Case Squad operation shall be considered
to be on active duty the same as if acting within the boundaries of
the City of Warson Woods.
B. Whenever
any Police Officer is duly authorized as a member of the Major Case
Squad he/she shall have the power to arrest anywhere within this State.
This power shall only be exercised during the time the Police Officer
is an active member of an active Major Case Squad and only within
the scope of the investigation on which the squad is working.
C. Prior
to the initiation of a Major Case Squad investigation in a political
subdivision other than where the crime occurred, a member of the Major
Case Squad shall notify the Chief Law Enforcement Officer of the political
subdivision in which the investigation is to be conducted or a designated
agent thereof.
D. For the
purpose of this Section the "Major Case Squad" shall
mean any formation, operation, organization or cooperative action
between any County, Governing Body, any Municipal Government and the
City of Warson Woods the purpose of which is intensive professional
investigation of certain individual crimes that may occur in their
general geographic area, and which is operated and activated on request
of a County Sheriff, County Police Superintendent or the Police Chief
of a political subdivision wherein a crime has occurred.

A. Identifying Unclaimed Property. All unclaimed property other
than money or cash coming into the possession of the Police Department
from any source whatever and having any value shall be properly marked
or catalogued so as to show its source and date of its receipt and
shall be kept and disposed of as herein provided.
B. Property To Be Sold At Public Auction. On the first (1st)
Wednesday of June of each year, or at such time as inventory deems
it, all such property which has remained unclaimed for more than one
(1) year, and the owner of which is unknown, shall be sold at public
auction by the Chief of Police or the Marshal at a suitable place
at Police Headquarters. Ten (10) days' notice of said sale shall be
published in a newspaper of general circulation; said notice to be
published not more than three (3) weeks prior to the day of said sale;
said notice shall set forth the place and time said auction is to
be held.
C. Proceeds Of Auction — Destruction Of Property. All
monies received from the sale of such property shall be turned over
to the Clerk of the City to be deposited in the General Revenue Fund
of the City. All property for which no bid is received at such auction
shall be destroyed by the Chief of Police in the presence of at least
one (1) member of the Board of Public Safety (other than the Chief
of Police) and a certificate of said destruction, signed by the Chief
of Police and the member of the Board of Public Safety present, shall
be filed with the City Clerk.
D. Disposition Of Money Or Cash. All money or cash coming into
the possession of the Police Department from any source whatever,
which has remained unclaimed and the owner unknown for a period of
at least one (1) year shall be turned over to the City Clerk and a
record thereof kept by him/her. Should the ownership of said money
or cash be established within a period of five (5) years from the
date of its receipt, then the Clerk shall return the same to the owner.
After a period of five (5) years, said unclaimed money or cash shall
become part of the General Revenue Fund of the City.
