As used in this Article, the following terms mean:
PRIVATE PROPERTY
Any place which at the time of the offense is not open to
the public. It includes property which is owned publicly or privately.
PUBLIC PLACE
Any place which at the time of the offense is open to the
public. It includes property which is owned publicly or privately.
A person commits the offense of unlawful assembly if he/she
knowingly assembles with six (6) or more other persons and agrees
with such persons to violate any of the criminal laws of this State
or of the United States with force or violence.
A person commits the offense of rioting if he/she knowingly
assembles with six (6) or more other persons and agrees with such
persons to violate any of the criminal laws of this State or of the
United States with force or violence and thereafter, while still so
assembled, does violate any of said laws with force or violence.
A person commits the offense of refusal to disperse if, being
present at the scene of an unlawful assembly or at the scene of a
riot, he/she knowingly fails or refuses to obey the lawful command
of a Law Enforcement Officer to depart from the scene of such unlawful
assembly or riot.
Where two (2) or more persons are engaged in disorderly conduct,
a Law Enforcement Officer may order the participants to disperse.
A person who purposely refuses or knowingly fails to obey such an
order commits the offense of failure to disperse.
It shall be unlawful for any person who owns, maintains, leases
or is otherwise in possession or control of any residential property
("premises") in the City of Warson Woods to permit or allow any person
who is present on such premises for any reason to conduct themselves
in a loud, disruptive or unruly manner so as to disturb the peace
and quiet enjoyment of any nearby residents, and it shall be the duty
of any such person in possession or control of such premises to take
such steps that are available to abate the actions of such persons
and to cause such loud, disruptive or unruly persons to leave the
area immediately.
All disorderly or indecent conduct, the use of threatening,
obscene or profane language and all acts or demeanor calculated or
tending to mar or disturb the feelings of others in public places
on the highways or thoroughfares of the City are prohibited.
