A. Definition. As used in this Chapter, the following term
shall have this prescribed meaning:
TEMPORARY STRUCTURE
Any structure of a temporary nature, including, but not limited
to, tents, canopies or membrane structures, that covers an area in
excess of one hundred forty-four (144) square feet, including connecting
areas or spaces with a common means of egress or entrance which are
used or intended to be used for the gathering together of ten (10)
or more persons.
B. In addition
to the general provisions of the Building Code pertaining to temporary
structures, the following specific conditions shall apply to all temporary
structures erected, operated or maintained upon a parcel within a
commercial zoning district of the City of Warson Woods:
1. All
applications for a permit to erect, operate or maintain a temporary
structure shall be completed by the owner of the parcel upon which
the temporary structure is to be placed or by any other interested
person who shall provide the parcel owner's certification that such
temporary structure shall be allowed upon his or her property for
a use related to such property.
2. In conjunction
with the application for a permit to erect, operate or maintain a
temporary structure, the applicant shall also submit a site plan indicating
the location of the temporary structure and information delineating
the means of egress and the occupant load.
3. Every
temporary structure erected on a parcel of property must be used for
a purpose related to such property.
4. All
temporary structures shall be removed within seventy-two (72) hours
of the erection of such temporary structure unless otherwise noted
upon the permit. Any temporary structure permit holder that fails
to have the temporary structure removed within seventy-two (72) hours
will be subject to a fine of up to two hundred dollars ($200.00) per
day for each day thereafter that the temporary structure remains erected.
5. Only
two (2) temporary structures shall be allowed per calendar year.
6. All
temporary structures erected in the City of Warson Woods shall conform
to the structural strength, fire safety, means of egress, accessibility,
light, ventilation and sanitary requirements of the Warson Woods Building
Code as necessary to ensure the public health, safety and general
welfare.
