A. Whenever
the City Council shall deem it necessary to condemn, acquire or appropriate
any private property within or without the City Limits of the City
of Palmyra, Missouri, for a particular purpose or purposes wherein
and for which the City, by the laws of the State of Missouri, is authorized
to so condemn, acquire or appropriate private property, the Council
shall be resolution cause a qualified surveyor to survey and make
a plat or map drawn to scale of the property to be so condemned, acquired
or appropriated, setting out the boundaries thereof and a description
of the property or right which the City desires to condemn, acquire
or appropriate, the dimensions of each lot or tract therein with the
name of the owner thereof written thereon if known, and if unknown,
it shall be so indicated on the plat or map; and if any property will
be benefitted by an improvement in connection with which condemnation
proceedings are brought, said resolution shall indicate the boundaries
of said benefit district and direct said surveyor to include in said
plat or map the entire district, setting out the boundaries thereon,
the name of the owner and the dimension of each lot or tract of property
in like manner as for the property to be condemned.
B. Upon the completion of the map or plat prepared according to Subsection
A above, said surveyor shall report to the City Council in writing that the same is completed and return the plat or map therewith, whereupon the City Council may approve or disapprove the same.
C. If the
plat or map shall be approved, the City Council shall, at its discretion,
by ordinance, declare that the City Council deems it necessary to
condemn, acquire or appropriate such property, particularly described
therein, and also the general nature or purpose of the use to which
such private property is to be put and declare it to be necessary
to take and appropriate such private property therein described for
such purpose or purposes. When any property will be benefitted by
an improvement in connection with which condemnation proceedings are
brought, the ordinance shall further define the boundaries of said
benefit district which property shall by the City Council be deemed
benefitted or assessed to pay for such improvement; and the ordinance
shall further direct the City Attorney or other legal representative
of the City to prepare a petition in conformity with the requirements
of the laws of the State of Missouri pertaining to such condemnation,
and to take such other action as may be necessary in conformity with
the requirements of the laws of the State of Missouri pertaining to
such condemnation, and cause the petition to be filed with the Clerk
of the Circuit Court of Marion County, Missouri.
