A. 
This Chapter consists of the rules and regulations for the operation of the Police Department of this City.
B. 
To the extent that this Chapter conflicts with the provisions of any Police Department policies, this Chapter shall prevail.
C. 
The Police Department shall be conservators of the peace and shall be active and vigilant in the preservation of the good order of the City of Peculiar, Missouri. They shall have the power to serve and execute all warrants, subpoenas, and writs or other processes, and to make arrests for any offense against the laws of the City of Peculiar or the State of Missouri. They may exercise such powers in areas leased or owned by the City, which may be outside of the normal boundaries of such City.
D. 
Any Police Officer of the City may provide assistance in emergency situations outside of the City limits in accordance with the Missouri Statutes for the Missouri Mutual Aid System or separate mutual aid agreements.

A. 
Under the direction of the City Administrator, the Chief of Police is directly responsible to the Board of Aldermen of the City of Peculiar for the effective operation of the Police Department and all of its employees, consistent with local, State, and Federal law.
B. 
The Chief of Police is responsible for the leadership, organization, and administrative oversight of the Police Department and Emergency Management. He or she shall have the power to perform such duties which may be necessary for the efficient operation, administration, and control of the Police Department of the City of Peculiar.
C. 
The Chief of Police shall adopt a policy and procedure for police pursuits. He or she shall be responsible for keeping the Board of Aldermen advised of what the pursuit policy is for the City of Peculiar.

A. 
Assignment of all Police Department employees is at the discretion of the Chief of Police. For purposes of this Chapter, the term "Police Officer" applies to all sworn Police Officers of the Department (full-time or reserve), and the term "support personnel" applies to all other persons employed by the Department.
B. 
The fundamental duties of a Police Officer include serving the community, preserving the public peace, preventing crime, detecting and arresting violators of the law, protecting life and property, and enforcing all criminal laws of the State of Missouri, Federal laws when appropriate, and ordinances of the City.

A. 
Police Officers are expected to conduct themselves in a manner that reflects positively on the City of Peculiar. Their actions, both on duty and off duty, will display the highest degree of integrity, service, bravery, and commitment to public safety. Violations of the law, Department and/or City operational procedures may be addressed as either criminal and/or personnel actions.
B. 
Each employee of the Police Department will be furnished with a copy of any rules, regulations, policies, and orders issued by the Chief of Police or the City of Peculiar, which they shall be familiar with at all times.
C. 
The conduct of operations of the Police Department shall be subject to the Police Operations Manual, a copy of which is available in the office of the City Administrator or the Chief of Police.

A. 
There is hereby established a Police Advisory Board, which may hereinafter be referred to as the "Police Board."
B. 
The purpose of the Police Board is to afford the citizens of Peculiar an unbiased group of citizens who will review new ideas given to the Police Board by the Chief of Police.
C. 
The Police Board may also receive complaints on police-related (not personnel) matters from members of the community who might not feel comfortable relaying those complaints or matters directly to the Police Department. Police Board members may relay those complaints to the Chief of Police or recommend to the City Administrator the action necessary to correct valid complaints.

The Police Board shall consist of five (5) members: four (4) members from residents at large and one (1) Board of Aldermen liaison who shall serve as Police Board Chairperson.
B. 
The Mayor shall, with the approval of the Board of Aldermen, appoint four (4) members from residents at large and one (1) Alderman to the Police Board who shall serve as Police Board Chairperson. Members of the Police Board shall be qualified voters of the City and shall have resided in the City for at least one (1) year prior to their appointment.

A. 
Police Board Members will be appointed for a three (3) year term, and Police Board Chairperson will be appointed for a one (1) year term.
B. 
Vacancies on the Board due to resignations, removal or other reasons will be filled by appointment and confirmation for the period of the unexpired term.

To meet quarterly to provide input to the Chief of Police about new policies and procedures.
B. 
The Police Board may also receive complaints on police-related (not personnel) matters from members of the community who might not feel comfortable relaying those complaints or matters directly to the Police Department. Police Board members may relay those complaints to the Chief of Police or recommend to the City Administrator the action necessary to correct valid complaints or eliminate a complaint or grievance. Recommendations to the City Administrator shall be submitted in writing. The City Administrator will take the Board's recommendation under advisement and subsequently administer the corrective action he/she deems necessary.

The Police Board may, by a simple majority vote, elect a Co-Chairperson to keep minutes of meetings, if necessary.

A. 
The Chairperson of the Police Board shall preside over the meetings. He or she shall call meetings quarterly to give valued input to the Chief of Police. Additional meetings may be called as necessary.
B. 
The Chairperson shall keep written notes of the meetings, unless the Board opts to elect a Co-Chairperson to keep minutes. The Chairperson must present the minutes to the office of the City Clerk in a timely manner.
C. 
The Chairperson shall give twenty-four (24) hours' advance notice of meetings called to Police Board members and citizens who submit police-related (not personnel) complaints.
D. 
The Police Board Chairperson will be an advisor to the Police Board and will serve as liaison between the Police Board and the Board of Aldermen.

The Chief of Police may be asked to attend such meetings. If the Chairman of the Police Board deems his appearance is necessary, the Chief of Police shall attend. Since police matters will be discussed at most meetings, it would be prudent for the Chief of Police to be in attendance but it is not a requirement.

A. 
Any citizen who has a complaint should submit it, in writing, to the Chief of Police. If the Chief of Police has the authority to settle or resolve the complaint, he or she will take the necessary action to solve the problem.
B. 
If said citizen is dissatisfied with the solution, and the complaint is not personnel-related, the complaint can then be forwarded by the complainant to the Police Board for review. The Board shall submit their recommendations, in writing, to the City Administrator for final action.
