It shall be unlawful for any person to sell or offer for sale, except from 8:00 A.M., June 28, to 10:00 P.M. July 4, any type or kind of fireworks or firecrackers within the corporate limits of this City.

A. 
No person, organization or corporation shall sell or display for sale any fireworks or firecrackers within the corporate limits of this City without first obtaining a license from the City for such sale or display.
B. 
Applications for fireworks licenses shall be made on or before June first (1st) of each year to the City Clerk. The following documents must be provided with the fireworks license application:
1. 
A license from the Missouri Division of Fire Safety.
2. 
State of Missouri temporary sales tax license.
3. 
Approval by the West Peculiar Fire District.
4. 
Certification of liability insurance for no less than one million dollars ($1,000,000.00).
5. 
Property owner or authorized agent authorization.
C. 
License fee for said fireworks licenses shall be fifty dollars ($50.00).

Every person who shall sell or display for sale any fireworks or firecrackers shall display in a conspicuous place a sign or placard, printed in bold letters not smaller than one (1) inch in height, stating the following:

STREETS, PARKS AND OTHER
PUBLIC PROPERTY OF

Fireworks and firecrackers shall not be sold or advertised for sale from any street, alley, sidewalk or other public property within the corporate limits.

Notwithstanding any other provisions of this Chapter, the Board of Aldermen hereby grants permission for limited use and sale within the City of those fireworks that are now or may hereafter be classified as common fireworks by the Interstate Commerce Commission, and are hereby labeled by said Commission as Class "C", all as now approved in the State of Missouri by Section 320.131, Revised Statutes of Missouri with the exception of those fireworks devices commonly known as bottle rockets. The sale, use and discharge of said enumerated items is hereby prohibited.

A. 
It shall be unlawful for any person to discharge or shoot any type of fireworks or firecrackers except for the following dates and times:
a.
July 1st — July 3rd
10:00 a.m. — 10:00 p.m.
b.
July 4th
10:00 a.m. — Midnight
B. 
It shall be unlawful for any person to discharge or shoot any type of fireworks or firecrackers at any other time than listed in Subsection (A) above, or at anytime on any public street, public sidewalk, public park, public grounds, or within the business district of the City.
C. 
The Board of Aldermen, by resolution, may permit the discharge or shooting of special fireworks on public or private property on July fourth (4th) or such other date as the Board may authorize, if the same is a public display for which no admission charge is collected and if the same is sponsored and conducted by the City or one (1) or more local organizations.

That the Board of Aldermen, by resolution, may permit the discharge or shooting of fireworks or firecrackers on public or private property within the business district on July 4, if the same is a public display, for which no admission charge is collected, and if the same is sponsored and conducted by a local organization.

Any person who shall shoot, ignite, or discharge in any manner any type of fireworks and who shall intentionally throw or explode or ignite the same in the general direction of any person in such manner as may risk bodily harm such person shall be deemed guilty of a misdemeanor.

Any person who shall within the corporate limits of the City of Peculiar, Missouri, toss, throw, or in any manner cause any type of fireworks to be discharged or ignited from a moving vehicle shall be deemed guilty of a misdemeanor. Any person within the corporate limits of the City of Peculiar, Missouri, who shall toss, throw or in any manner cause any type of fireworks to be discharged or ignited in the direction of any vehicle, whether moving or stopped, shall be deemed guilty of a misdemeanor.
