As used in this Chapter, the following terms shall have these prescribed meanings:
GARAGE SALE
A sale upon the premises of or within any dwelling, garage, accessory building or any other building including, but not limited to, sales conducted in a basement, patio or yard.
GOODS
Any property capable of being the object of a sale regulated hereunder.
PERSON
Any person, firm, partnership, association, organization or corporation of any kind.

No garage sale shall be held or scheduled for more than three (3) consecutive calendar days. No person shall conduct a garage sale more than twice in any one (1) calendar year; nor shall any garage sale occur more often than twice in any one (1) calendar year on the same premises.

No goods offered for sale at a garage sale shall be displayed for sale on any public street or right- of-way.

No more than five (5) signs no larger than two (2) feet by three (3) feet shall be posted advertising the sale within the City. Signs may be posted one (1) day prior to the sale and must be removed at the end of the last day of the sale. The person responsible for conducting any such garage sale shall be responsible for removing any such sign. All signs must have the name of the applicant, dates of the sale and address of the applicant. Self-supporting signs may be posted on City right-of-way. Signs may not be posted on utility poles, street signs, traffic signs or on private property without the permission of the owner.

Any sale conducted pursuant to the provisions of this Chapter shall be confined to the period between 7:00 A.M. and 8:00 P.M. and shall not extend in excess of three (3) days.

Any person conducting a garage sale or other sale involving the offering for sale of goods on property zoned and occupied as a residence shall be required to obtain a permit from the City. Applications for such permit shall be made to the City Clerk at least forty-eight (48) hours prior to the date of the sale and such form as may be required by the City and no fee shall be required by the City. The permit for sale must be displayed in a prominent place at the residence for which the permit was obtained.

The provisions of this Chapter shall not apply to or affect persons selling goods pursuant to an order of process of a court of competent jurisdictions or persons acting in accordance with their powers and duties as public officials. Further, the provisions of this Chapter do not apply to City-wide sponsored sales.

Any person deemed in violation of the provisions of this Chapter shall be fined in the sum of not less than twenty-five dollars ($25.00), nor more than one hundred dollars ($100.00) for each violation.
