No person shall throw or deposit litter in or upon any street,
sidewalk or other public place within the City, except in public receptacles
or authorized private receptacles.

Persons placing litter in public receptacles or in authorized
private receptacles shall do so in such a manner as to prevent it
from being carried or deposited by the elements upon any street, sidewalk
or other public place or upon private property.

A.
No
person shall sweep into or deposit in any gutter, street or other
public place within the City the accumulation of litter from any building
or lot or from any public or private sidewalk or driveway.
B.
Definition. Within the meaning of this Section, the word "litter" shall include, without excluding other substances,
fallen leaves, cut weeds, grass clippings, branches and twigs that
may accumulate on any building, lot or premises.

No person shall burn any litter as defined in Section 220.030(B), in any street, gutter or other public place within the City.

Persons owning or occupying property shall keep the sidewalk
in front of their premises free of litter. Persons owning or occupying
places of business within the City shall keep the front of their business
premises free of litter.

A.
No
person, while a driver or passenger in a vehicle, shall throw or deposit
litter upon any street or other public place within the City, or upon
private property.
B.
No
driver of any vehicle shall allow any passenger in that vehicle to
throw or deposit litter upon any street or other public place within
the City, or upon private property.

No person shall drive or move any truck or other vehicle hauling
or transporting litter within or about the City, unless such vehicle
is so constructed and the load secured so as to prevent any of the
contents therein being blown, dropped or deposited upon any street,
alley or other public place.

No person shall throw or deposit on any private property within
the City, whether owned by such person or not, except that the owner
or person in control of private property may maintain authorized private
receptacles for collection in such a manner that litter will be prevented
from being carried or deposited by the elements upon any street, sidewalk
or other public place or upon any private property owned by another.

Any person violating any of the provisions of this Chapter,
or any lawful rules or regulations promulgated pursuant thereto, upon
conviction, shall be punished by a fine of not more than two hundred
dollars ($200.00) for the first violation, two hundred seventy-five
dollars ($275.00) for the second violation, three hundred fifty dollars
($350.00) for the third violation, and four hundred fifty dollars
($450.00) for the fourth and any subsequent violations, for offenses
committed within a twelve-month period.
